 1                    AMENDMENT TO HOUSE BILL 1886

 2        AMENDMENT NO.     .  Amend House Bill 1886 on page 1,  by
 3    replacing lines 22 through 29 with the following:

 4        "Section 15.  Kids Share Endowment Authority and Program;
 5    Board of Directors.
 6        (a)  The  Kids  Share  Endowment  Authority is created to
 7    administer the Program under this Act.
 8        (b)  The Kids Share Endowment Program is  created  within
 9    the Authority.
10        (c)  The  governing powers of the Authority are vested in
11    a Board of Directors of the Kids Share  Endowment  Authority.
12    The  chairperson of the Board is the  Governor.  There are 19
13    additional voting members:
14             (1)  as ex officio members, each of the following or
15        his or her respective designee: the State  Superintendent
16        of  Education,  the  Secretary  of  Human  Services,  the
17        Director  of Public Health, the Attorney General, and the
18        Director of Children and Family Services;
19             (2)  4 members appointed by  the  Governor  who  are
20        members  of  the General Assembly, 2 of whom are Senators
21        and not of the same political party and  2  of  whom  are
22        Representatives and not of the same political party; and
23             (3)  10 members appointed by the Governor, including

 1        one   each  representing  social  services,  a  statewide
 2        organization    representing    education,    a     civic
 3        organization,    business,   a   statewide   organization
 4        representing  the   interests   of   children,   parents,
 5        research,    a    statewide   organization   representing
 6        municipalities, a statewide organization representing law
 7        enforcement, and a  statewide  organization  representing
 8        park districts.
 9        The  non-legislative appointed members shall be appointed
10    for 3-year terms.  Of the non-legislative  members  initially
11    appointed by the Governor under this Act, 3 shall serve until
12    July  1,  2003, 3 shall serve until July 1, 2004, and 4 shall
13    serve until July 1, 2005.  Legislative  members  shall  serve
14    during  the  term for which they where elected to the General
15    Assembly.
16        Eleven members constitute a quorum. The members shall not
17    receive any compensation but  shall  be  reimbursed  for  all
18    reasonable and necessary expenses incurred in the performance
19    of their duties."; and

20    on page 2, by deleting lines 1 through 26; and

21    on  page  6,  by  replacing  lines  33  through  34  with the
22    following:
23        "(c)  For the 6-year period beginning on July 1, 2002, as
24    soon as practical after  July  1  of  each  year,  the  State
25    Comptroller  shall  order transferred and the State Treasurer
26    shall transfer from the Tobacco Settlement Recovery Fund into
27    the Kids Share Endowment Program Fund the sum of  $50,000,000
28    from  deposits made into the Tobacco Settlement Recovery Fund
29    during the fiscal year immediately preceding July 1  of  each
30    of these respective years."; and

31    on page 7, by deleting lines 1 through 10.
