Amend House Bill 1935 as follows: 3 by replacing everything after the enacting clause with the 4 following: 5 "Section 5. The Counties Code is amended by adding 6 Sections 3-2010.5 and 3-11010.5 as follows: 7 (55 ILCS 5/3-2010.5 new) 8 Sec. 3-2010.5. Heirloom marriage certificate. The clerk 9 in counties with a population over 2,000,000 may issue an 10 heirloom marriage certificate as prescribed under Section 202 11 of the Illinois Marriage and Dissolution of Marriage Act. 12 The fee for the certificate shall be determined by the State 13 Registrar and shall include the cost of production and 14 issuance of the heirloom marriage certificate and an 15 additional sum of $25, and $25 of that fee shall be 16 transferred to the county treasurer for deposit into the 17 County Affordable Housing Fund. 18 (55 ILCS 5/3-11010.5 new) 19 Sec. 3-11010.5. County Affordable Housing Fund. The 20 treasurer in counties with a population over 2,000,000 shall 21 establish a County Affordable Housing Fund for deposit of -2- LRB9200654ARsbam01 1 fees as required by Section 3-2010.5 for heirloom marriage 2 certificates. The moneys in the Fund shall be used for 3 grants and for affordable housing programs in the county. 4 Not less than 50% of those moneys shall be used as grants to 5 municipalities with a population of over 500,000 for 6 affordable housing programs in those municipalities. 7 Section 10. The Illinois Marriage and Dissolution of 8 Marriage Act is amended by changing Section 202 as follows: 9 (750 ILCS 5/202) (from Ch. 40, par. 202) 10 Sec. 202. Marriage License and Marriage Certificate.) 11 (a) The Director of Public Health shall prescribe the form 12 for an application for a marriage license, which shall 13 include the following information: 14 (1) name, sex, occupation, address, social security 15 number, date and place of birth of each party to the proposed 16 marriage; 17 (2) if either party was previously married, his name, 18 and the date, place and court in which the marriage was 19 dissolved or declared invalid or the date and place of death 20 of the former spouse; 21 (3) name and address of the parents or guardian of each 22 party; and 23 (4) whether the parties are related to each other and, 24 if so, their relationship. 25 (b) The Director of Public Health shall prescribe the 26 forms for the marriage license, the marriage certificate, the 27 heirloom marriage certificate for counties with a population 28 over 2,000,000, and, when necessary, the consent to marriage. 29 (Source: P.A. 80-923.) 30 Section 99. Effective date. This Act takes effect upon 31 becoming law.".
