92_HB2000 LRB9205394DJgcA 1 AN ACT in relation to tobacco. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Tobacco Settlement Recovery Fund Appropriations Act. 6 Section 5. Expenditures from the Fund. Expenditures 7 shall be made from the Tobacco Settlement Recovery Fund to 8 promote tobacco use cessation and prevention and to improve 9 the health of the citizens of Illinois by funding the 10 activities described in Articles 5 through 25 of the Tobacco 11 Settlement Recovery Fund Uses Act, as well as other 12 activities as provided in this Act. 13 Section 7. Definitions. In this Act: 14 "Article" and "Section" refer to Articles and Sections of 15 the Tobacco Settlement Recovery Fund Uses Act. 16 Section 10. Fiscal year 2002 appropriations. During 17 fiscal year 2002, the General Assembly must appropriate from 18 the Tobacco Settlement Recovery Fund at least $232,500,000 as 19 follows: 20 (1) For Article 5, Section 5-15: $67,000,000. 21 (2) For Article 5, Section 5-40: $3,000,000, plus 22 matching federal funds. 23 (3) For grants and pharmaceutical assistance under 24 the Senior Citizens and Disabled Persons Property Tax 25 Relief and Pharmaceutical Assistance Act: $70,000,000. 26 (4) For free medical clinic grants under Section 27 2310-295 of the Department of Public Health Powers and 28 Duties Law of the Civil Administrative Code of Illinois: 29 $5,000,000. -2- LRB9205394DJgcA 1 (5) For Article 15: $20,000,000. 2 (6) For Article 20: $28,000,000. 3 (7) For Article 25: $39,500,000, of which 4 $39,000,000 must be allocated to programs under 5 subsection (a) of Section 25-30 and $500,000 must be 6 allocated for expenses to establish programs under 7 subsection (b) of Section 25-30. 8 The General Assembly must appropriate additional amounts 9 from the Tobacco Settlement Recovery Fund, if available and 10 as necessary, to implement the programs described in Articles 11 5 through 25 of the Tobacco Settlement Recovery Fund Uses 12 Act. Any amounts in the Tobacco Settlement Recovery Fund in 13 excess of the amounts appropriated under this Section must be 14 held for expenditure in future years. Any appropriated 15 amounts not spent during fiscal year 2002 must remain in the 16 Tobacco Settlement Recovery Fund for expenditure in future 17 years. 18 Section 15. Fiscal year 2003 appropriations. During 19 fiscal year 2003, the General Assembly must appropriate from 20 the Tobacco Settlement Recovery Fund at least $301,000,000 as 21 follows: 22 (1) For Article 5, Section 5-30: $80,000,000. 23 (2) For Article 5, Section 5-40: $6,000,000, plus 24 matching federal funds. 25 (3) For grants and pharmaceutical assistance under 26 the Senior Citizens and Disabled Persons Property Tax 27 Relief and Pharmaceutical Assistance Act: $70,000,000. 28 (4) For free medical clinic grants under Section 29 2310-295 of the Department of Public Health Powers and 30 Duties Law of the Civil Administrative Code of Illinois: 31 $5,000,000. 32 (5) For Article 15: $20,000,000. 33 (6) For Article 20: $42,000,000. -3- LRB9205394DJgcA 1 (7) For Article 25: $78,000,000. 2 The General Assembly must appropriate additional amounts 3 from the Tobacco Settlement Recovery Fund, if available and 4 as necessary, to implement the programs described in Articles 5 5 through 25 of the Tobacco Settlement Recovery Fund Uses 6 Act. Any amounts in the Tobacco Settlement Recovery Fund in 7 excess of the amounts appropriated under this Section must be 8 held for expenditure in future years. Any appropriated 9 amounts not spent during fiscal year 2003 must remain in the 10 Tobacco Settlement Recovery Fund for expenditure in future 11 years. 12 Section 20. Fiscal year 2004 appropriations. During 13 fiscal year 2004, the General Assembly must appropriate from 14 the Tobacco Settlement Recovery Fund at least $301,000,000 as 15 follows: 16 (1) For Article 5, Section 5-30: $80,000,000. 17 (2) For Article 5, Section 5-40: $6,000,000, plus 18 matching federal funds. 19 (3) For grants and pharmaceutical assistance under 20 the Senior Citizens and Disabled Persons Property Tax 21 Relief and Pharmaceutical Assistance Act: $70,000,000. 22 (4) For free medical clinic grants under Section 23 2310-295 of the Department of Public Health Powers and 24 Duties Law of the Civil Administrative Code of Illinois: 25 $5,000,000. 26 (5) For Article 15: $20,000,000. 27 (6) For Article 20: $42,000,000. 28 (7) For Article 25: $78,000,000. 29 The General Assembly must appropriate additional amounts 30 from the Tobacco Settlement Recovery Fund, if available and 31 as necessary, to implement the programs described in Articles 32 5 through 25 of the Tobacco Settlement Recovery Uses Act. Any 33 amounts in the Tobacco Settlement Recovery Fund in excess of -4- LRB9205394DJgcA 1 the amounts appropriated under this Section must be held for 2 expenditure in future years. Any appropriated amounts not 3 spent during fiscal year 2004 must remain in the Tobacco 4 Settlement Recovery Fund for expenditure in future years. 5 Section 25. Further appropriations. For fiscal year 2005 6 and each fiscal year thereafter, the General Assembly must 7 appropriate from the Tobacco Settlement Recovery Fund amounts 8 equal to at least those set forth in Section 20. The General 9 Assembly must appropriate amounts as necessary to implement 10 the programs described in Articles 5 through 25 of the 11 Tobacco Settlement Recovery Fund Uses Act. 12 Section 99. Effective date. This Act takes effect upon 13 becoming law.
