92_HB2089 LRB9206788LDprB 1 AN ACT in relation to child care. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Child Care Act of 1969 is amended by 5 adding Section 4.5 as follows: 6 (225 ILCS 10/4.5 new) 7 Sec. 4.5. Employee drug testing; report. 8 (a) A child care facility shall test each of its 9 employees for illegal drugs at the time their licenses are 10 issued or renewed. The cost of an employee's drug test under 11 this Section shall be paid by the child care facility that 12 employs him or her. The administration of drug tests 13 required under this Section is a condition of child care 14 facility license issuance or renewal under this Act. 15 (b) In addition to the drug tests required under 16 subsection (a), the Department shall institute a pilot 17 program whereby it shall conduct random, unannounced drug 18 tests of a representative sample of persons subject to drug 19 tests under subsection (a). 20 (c) The Illinois Department of Children and Family 21 Services shall report the results of testing required under 22 this Section to the General Assembly by March 1, 2003. 23 Section 99. Effective date. This Act takes effect 24 January 1, 2002.
