92_HB2372 LRB9205286EGfg 1 AN ACT in relation to public employee benefits. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Pension Code is amended by 5 changing Section 15-146 as follows: 6 (40 ILCS 5/15-146) (from Ch. 108 1/2, par. 15-146) 7 Sec. 15-146. Survivors insurance benefits - Minimum 8 amounts. 9 (a) The minimum total survivors annuity payable on 10 account of the death of a participant shall be 60% (50% if 11 the death occurred before the effective date of this 12 amendatory Act of the 92nd General Assembly) of the 13 retirement annuity which would have been provided under Rule 14 1, Rule 2, Rule 3, or Rule 5 of Section 15-136 upon the 15 participant's attainment of the minimum age at which the 16 penalty for early retirement would not be applicable or the 17 date of the participant's death, whichever is later, on the 18 basis of credits earned prior to the time of death. 19 (b) The minimum total survivors annuity payable on 20 account of the death of an annuitant shall be 60% (50% if the 21 death occurred before the effective date of this amendatory 22 Act of the 92nd General Assembly) of either the retirement 23 annuity which is payable under Section 15-136 at the time of 24 death or50% ofthe disability retirement annuity payable 25 under Section 15-153.2, whichever is applicable. 26 (b-5) This minimum survivors annuity shall apply to each 27 participant and annuitant who dies after September 16, 1979, 28 whether or not his or her employee status terminates before 29 or after that date. 30 The changes to this Section made by this amendatory Act 31 of the 92nd General Assembly apply without regard to whether -2- LRB9205286EGfg 1 the deceased participant or annuitant was in service on or 2 after the effective date of this amendatory Act. 3 (c) If an annuitant has elected a reversionary annuity, 4 the retirement annuity referred to in this Section is that 5 which would have been payable had such election not been 6 filed. 7 (Source: P.A. 90-448, eff. 8-16-97; 90-766, eff. 8-14-98; 8 91-887, eff. 7-6-00.) 9 Section 99. Effective date. This Act takes effect upon 10 becoming law.
