92_HB2373 LRB9204685JSpcA 1 AN ACT relating to insurance. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Insurance Code is amended by 5 changing Section 351B-3 as follows: 6 (215 ILCS 5/351B-3) (from Ch. 73, par. 963B-3) 7 Sec. 351B-3. Small employer group accident and health 8 insurance. 9 (a) Small employer group accident and health insurance 10 is hereby declared to be that form of accident and health 11 insurance that provides coverage for each person insured 12 under the group policy for the expenses incurred because of 13 care rendered by a physician or hospital for the treatment of 14 an injury or sickness and which covers at least 2 but not 15 more than 5025employees, members, or employees of members 16 (exclusive of dependents) written under a master policy 17 issued to any governmental corporation, unit, agency, or 18 department thereof or to any corporation, copartnership, or 19 individual employer or to any association upon application of 20 an executive officer or trustee of an association having a 21 constitution or bylaws and formed in good faith for purposes 22 other than that of obtaining insurance, where officers, 23 members, employees, or employees of members or classes or 24 departments thereof may be insured for their individual 25 benefit. In addition, a small employer group accident and 26 health policy may be written to insure any group that may be 27 insured under a group life insurance policy as long as the 28 number of employees, members, or employees of members 29 (exclusive of dependents) is at least 2 butdoesnot more 30 thanexceed5025. The term "employees" shall include the 31 officers, managers, and employees of subsidiary or affiliated -2- LRB9204685JSpcA 1 corporations, and the individual proprietors, partners, and 2 employees of affiliated individuals or firms when the 3 business of the subsidiary or affiliated corporations or 4 affiliated firms or individuals is controlled by a common 5 employer through stock ownership, contract, or otherwise. 6 (b) For the purpose of providing coverage authorized 7 under this Article a trust composed of employers or members 8 each of which has at least 2 but not more than 5025 or fewer9employees(exclusive of dependents) may serve as the master 10 policyholder. 11 (Source: P.A. 86-1407.)
