92_HB3092 LRB9201931LDpr 1 AN ACT in relation to gambling. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Alcoholism and Other Drug Abuse and 5 Dependency Act is amended by changing Section 5-20 as 6 follows: 7 (20 ILCS 301/5-20) 8 Sec. 5-20. Compulsive gambling program. 9 (a) Subject to appropriation, the Department shall 10 establish a program for public education, research, and 11 training regarding problem and compulsive gambling and the 12 treatment and prevention of problem and compulsive gambling. 13 Subject to specific appropriation for these stated purposes, 14 the program must include all of the following: 15 (1) Establishment and maintenance of a toll-free 16 "800" telephone number to provide crisis counseling and 17 referral services to families experiencing difficulty as 18 a result of problem or compulsive gambling. 19 (2) Promotion of public awareness regarding the 20 recognition and prevention of problem and compulsive 21 gambling. 22 (3) Facilitation, through in-service training and 23 other means, of the availability of effective assistance 24 programs for problem and compulsive gamblers. 25 (4) Conducting studies to identify adults and 26 juveniles in this State who are, or who are at risk of 27 becoming, problem or compulsive gamblers. 28 (b) Subject to appropriation, the Department shall 29 either establish and maintain the program or contract with a 30 private or public entity for the establishment and 31 maintenance of the program. Subject to appropriation, either -2- LRB9201931LDpr 1 the Department or the private or public entity shall 2 implement the toll-free telephone number, promote public 3 awareness, and conduct in-service training concerning problem 4 and compulsive gambling. 5 (c) Subject to appropriation, the Department shall 6 produce and supply the signs specified in Section 10.7 of the 7 Illinois Lottery Law, Section 34.1 of the Illinois Horse 8 Racing Act of 1975, Section 4.3 of the Bingo License and Tax 9 Act, Section 8.1 of the Charitable Games Act, and Section 10 13.1 of the Riverboat Gambling Act. 11 (d) Each year, $3,000,000 shall be appropriated from the 12 State Gaming Fund to the Gambling Health and Welfare Fund, 13 which is hereby created as a special fund in the State 14 Treasury. Moneys in the Fund shall be used, subject to 15 appropriation, by the Department of Human Services to fund 16 the compulsive gambling treatment program established 17 pursuant to this Section. 18 (Source: P.A. 89-374, eff. 1-1-96; 89-626, eff. 8-9-96.) 19 Section 10. The Department of Human Services Act is 20 amended by adding Section 10-30 as follows: 21 (20 ILCS 1305/10-30 new) 22 Sec. 10-30. Study of gambling-related crime. 23 (a) Each calendar year, beginning in calendar year 2001, 24 any Illinois institution of higher education may apply to the 25 Department to conduct a study tracking gambling-related crime 26 in Illinois during that year. Each year, the Department 27 shall select one applicant to conduct that year's study. In 28 selecting an applicant to conduct each annual study, the 29 Department shall consider (i) whether the applicant has 30 conducted any relevant studies in the past, (ii) the 31 estimated cost of the applicant's study, and (iii) the 32 credentials of the researcher the applicant proposes to use -3- LRB9201931LDpr 1 to conduct the study. 2 (b) As soon as possible after the end of each calendar 3 year, any institution of higher education that conducted a 4 study pursuant to this Section shall report its findings to 5 the General Assembly. The General Assembly shall make the 6 results of all studies conducted pursuant to this Section 7 available to any institution of higher education that is 8 currently conducting a study pursuant to this Section. 9 Section 15. The State Finance Act is amended by adding 10 Section 5.545 as follows: 11 (30 ILCS 105/5.545 new) 12 Sec. 5.545. The Gambling Health and Welfare Fund. 13 Section 20. The Riverboat Gambling Act is amended by 14 adding Section 16.1 as follows: 15 (230 ILCS 10/16.1 new) 16 Sec. 16.1. Compulsive gambling study. Within 6 months 17 after the effective date of this amendatory Act of the 92nd 18 General Assembly, the Board shall conduct a study to 19 determine the prevalence of compulsive gambling in Illinois. 20 The Board shall report its findings to the General Assembly 21 as soon as is practicable after they are compiled. The Board 22 shall conduct another study to determine the prevalence of 23 compulsive gambling in Illinois during the first 4 years 24 after a riverboat begins conducting gambling in a new 25 location pursuant to Section 11.2. The Board shall report 26 its findings to the General Assembly as soon as is 27 practicable after they are compiled. 28 Section 99. Effective date. This Act takes effect upon 29 becoming law.
