 1                    AMENDMENT TO HOUSE BILL 3123

 2        AMENDMENT NO.     .  Amend House Bill  3123  on  page  1,
 3    immediately below line 8, by inserting the following:
 4        ""Active  paid  on-call firefighter" means a member of an
 5    active volunteer fire department who has had  basic  training
 6    as  defined in subsection f of Section 2 of the Illinois Fire
 7    Protection Training Act and in the past  12  months  has  (i)
 8    participated  in  all  required  training exercises, (ii) has
 9    responded to a fire or other emergency call,  and  (iii)  has
10    received  a  form of monetary compensation for each emergency
11    situation he or she has responded to.
12        "Active  volunteer  fire   department"   means   a   fire
13    department  that  is staffed by volunteers for the purpose of
14    combating fires.
15        "Active volunteer  firefighter"  means  a  member  of  an
16    active  volunteer  fire department who has had basic training
17    as defined in subsection f of Section 2 of the Illinois  Fire
18    Protection  Training  Act  and  in the past 12 months has (i)
19    participated in all required training exercises and (ii)  has
20    responded to a fire or other emergency call.
21        "Fees"  means  matriculation, graduation, activity, term,
22    or incidental fees.  Exemption shall not be granted from  any
23    other  fees,  including  book  rental,  service,  laboratory,
24    supply,   and  union  building  fees,  hospital  and  medical

 1    insurance fees, and any fees established  for  the  operation
 2    and  maintenance of buildings, the income of which is pledged
 3    to the payment of interest and principal on bonds  issued  by
 4    the governing board of any university or community college.";
 5    and

 6    on page 1, by deleting lines 24 through 31; and

 7    on  page  2,  line 1, by replacing "Any" with "Subject to the
 8    limitations provided in this Section, any"; and

 9    on page 2, line 2, by replacing "volunteer  or  paid  on-call
10    firefighter"  with  "volunteer,  paid  on-call,  or full-time
11    firefighter with a fire department in a municipality  with  a
12    population of less than 5,000"; and

13    on  page  2, lines 10 and 11, by replacing "volunteer or paid
14    on-call  firefighter."  with  "volunteer,  paid  on-call,  or
15    full-time firefighter with that  fire  department.   However,
16    not   more   than  2  grants  per  year  may  be  awarded  to
17    firefighters within the same fire department."; and

18    on page 2, lines 12 and 13, by replacing "volunteer  or  paid
19    on-call   firefighter"  with  "volunteer,  paid  on-call,  or
20    full-time firefighter with the fire department that he or she
21    was with to qualify for the grant"; and

22    on page 2, line 15, by replacing "volunteer or  paid  on-call
23    firefighter"  with  "volunteer,  paid  on-call,  or full-time
24    firefighter with that fire department"; and

25    on page 2,  immediately  below  line  19,  by  inserting  the
26    following:
27        "Before receiving grant assistance under this Section for
28    any  academic year, each grant recipient shall be required by
29    the Commission to sign an agreement under which the recipient
30    pledges that he or she (i) shall remain an active  volunteer,
31    paid   on-call,   or  full-time  firefighter  with  the  fire

 1    department that he or she was with to qualify for  the  grant
 2    for a period of not less than one year for each year of grant
 3    assistance  that  he  or  she receives under this Section and
 4    (ii) shall, upon  request  by  the  Commission,  provide  the
 5    Commission  with evidence that he or she is fulfilling or has
 6    fulfilled this obligation.  If the recipient fails to fulfill
 7    this  obligation,  then  the  Commission  shall  require  the
 8    recipient  to  repay  the  amount  of  the  grant  assistance
 9    received,  prorated  according  to  the   fraction   of   the
10    obligation  not completed, at a rate of interest equal to 5%,
11    and, if applicable, to pay  reasonable  collection  fees.   A
12    recipient  who  is  enrolled  in  an  institution  of  higher
13    learning  shall not be required to commence repayment so long
14    as he or she remains enrolled in  an  institution  of  higher
15    learning  on  a  full-time basis or if he or she can document
16    for  the  Commission  special  circumstances   that   warrant
17    extension  of  the  time  before  repayment is required.  The
18    Commission is authorized to establish rules relating  to  its
19    collection activities for repayment of grant assistance under
20    this  Section.  All  repayments  collected under this Section
21    shall be forwarded to the State Comptroller for deposit  into
22    the   General   Revenue  Fund.   A  recipient  shall  not  be
23    considered  in  violation  of  the  agreement  entered   into
24    pursuant  to  this  subsection  (b)  if  the recipient (i) is
25    serving as a member of  the  armed  services  of  the  United
26    States,  for  a period of time not to exceed 3 years, (ii) is
27    temporarily totally disabled, for a period  of  time  not  to
28    exceed  3  years,  as  established  by  sworn  affidavit of a
29    qualified physician, or  (iii)  becomes  permanently  totally
30    disabled,  as  established  by sworn affidavit of a qualified
31    physician.".
