92_HB3179 LRB9204612WHcsA 1 AN ACT concerning consumer fraud. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Consumer Fraud and Deceptive Business 5 Practices Act is amended by adding Section 2B.3 as follows: 6 (815 ILCS 505/2B.3 new) 7 Sec. 2B.3. Deceptive sale or promotion of health-related 8 cash discount cards. It is an unlawful practice for any 9 person to sell, market, promote, advertise, or otherwise 10 distribute any card or other purchasing mechanism or device 11 that purports to offer discounts or access to discounts from 12 health care providers in health related purchases if: 13 (1) the card or other purchasing mechanism or 14 device does not expressly provide in bold and prominent 15 type that the discounts are not insurance; 16 (2) the discounts are not specifically authorized 17 by a contract with each health care provider listed in 18 conjunction with the card or other purchasing mechanism 19 or device; or 20 (3) the discounts or access to discounts offered or 21 the range of discounts or access to the range of 22 discounts offered are misleading, deceptive or 23 fraudulent, regardless of the literal wording used.
