92_HB3197 LRB9205576DJdv 1 AN ACT in relation to public aid. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Public Aid Code is amended by 5 changing Section 5-4.1 as follows: 6 (305 ILCS 5/5-4.1) (from Ch. 23, par. 5-4.1) 7 Sec. 5-4.1. Co-payments. The Department may by rule 8 provide that recipients under any Article of this Code (other 9 than group care recipients) shall pay a fee as a co-payment 10 for services. Co-payments may not exceed $1one dollarfor 11 pharmacy services, physicians services, dental services, 12 optical services and supplies, chiropractic services, 13 podiatry services, and encounter rate clinic services. 14 Co-payments may not exceed $3three dollarsfor hospital 15 outpatient and clinic services. Notwithstanding any other 16 provision of this Section, co-payments for generic 17 prescription drugs may not exceed $0.50 per prescription. 18 Provided, however, that any such rule must provide that no 19 co-payment requirement can exist for renal dialysis, 20 radiation therapy, cancer chemotherapy, or insulin, and other 21 products necessary on a recurring basis, the absence of which 22 would be life threatening, or where co-payment expenditures 23 for required services and/or medications for chronic diseases 24 that the Illinois Department shall by rule designate shall 25 cause an extensive financial burden on the recipient, and 26 provided no co-payment shall exist for emergency room 27 encounters which are for medical emergencies. 28 (Source: P.A. 82-664.)
