92_HB3202 LRB9201211RCcd 1 AN ACT to amend the Unemployment Insurance Act by 2 changing Section 703. 3 Be it enacted by the People of the State of Illinois, 4 represented in the General Assembly: 5 Section 5. The Unemployment Insurance Act is amended by 6 changing Section 703 as follows: 7 (820 ILCS 405/703) (from Ch. 48, par. 453) 8 Sec. 703. Reconsideration of findings or determinations. 9 The claims adjudicator may reconsider his finding at any 10 time within thirteen weeks after the close of the benefit 11 year. He may reconsider his determination at any time within 12 one year after the last day of the week for which the 13 determination was made, except that if the issue is whether 14 or not, by reason of a back pay award made by any 15 governmental agency or pursuant to arbitration proceedings, 16 or by reason of a payment of wages wrongfully withheld by an 17 employing unit, an individual has received wages for a week 18 with respect to which he or she has received benefits or if 19 the issue is whether or not the claimant misstated his 20 earnings for the week, such reconsidered determination may be 21 made at any time within 5twoyears after the last day of the 22 week. No finding or determination shall be reconsidered at 23 any time after appeal therefrom has been taken pursuant to 24 the provisions of Section 800, except where a case has been 25 remanded to the claims adjudicator by a Referee, the Director 26 or the Board of Review, and except, further, that if an issue 27 as to whether or not the claimant misstated his earnings is 28 newly discovered, the determination may be reconsidered after 29 and notwithstanding the fact that the decision upon the 30 appeal has become final. Notice of such reconsidered 31 determination or reconsidered finding shall be promptly given -2- LRB9201211RCcd 1 to the parties entitled to notice of the original 2 determination or finding, as the case may be, in the same 3 manner as is prescribed therefor, and such reconsidered 4 determination or reconsidered finding shall be subject to 5 appeal in the same manner and shall be given the same effect 6 as is provided for an original determination or finding. 7 (Source: P.A. 77-1443.)
