92_HB3399 LRB9206671MWmg 1 AN ACT concerning nuisance vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Counties Code is amended by changing 5 Section 5-1092 as follows: 6 (55 ILCS 5/5-1092) (from Ch. 34, par. 5-1092) 7 Sec. 5-1092. Inoperable or operable motor vehicles. A 8 county board may declare by ordinance inoperable or operable 9 motor vehicles, whether on public or private property, to be 10 a nuisance and authorize fines to be levied for the failure 11 of any person to obey a notice received from the county which 12 states that such person is to dispose of any inoperable or 13 operable motor vehicles under his control, and may authorize 14 a law enforcement agency, with applicable jurisdiction, to 15 remove, after 7 days from the issuance of the county notice, 16 any inoperable or operable motor vehicle or parts thereof. 17 However, nothing in this Section shall apply to any motor 18 vehicle that is kept within a building when not in use, to 19 operable historic vehicles over 25 years of age, or to a 20 motor vehicle on the premises of a place of business engaged 21 in the wrecking or junking of motor vehicles. 22 As used in this Section, "inoperable motor vehicle" means 23 any motor vehicle from which, for a period of at least 7 days 24 or any longer period of time fixed by ordinance, the engine, 25 wheels or other parts have been removed, or on which the 26 engine, wheels or other parts have been altered, damaged or 27 otherwise so treated that the vehicle is incapable of being 28 driven under its own motor power. "Inoperable motor vehicle" 29 shall not include a motor vehicle which has been rendered 30 temporarily incapable of being driven under its own motor 31 power in order to perform ordinary service or repair -2- LRB9206671MWmg 1 operations. 2 (Source: P.A. 86-962.)
