Amend House Bill 3581, AS AMENDED, 3 by replacing everything after the enacting clause with the 4 following: 5 "Section 5. The Election Code is amended by changing 6 Section 9-25 and by adding Section 9-25.5 as follows: 7 (10 ILCS 5/9-25) (from Ch. 46, par. 9-25) 8 Sec. 9-25. Anonymous contributions and contributions in 9 the name of another person prohibited. 10 (a) No person shall make an anonymous contribution or a 11 contribution in the name of another person, and no person 12 shall knowingly accept any anonymous contribution or 13 contribution made by one person in the name of another 14 person. 15 (b) Anonymous contributions and contributions in the 16 name of another person shall escheat to the State of 17 Illinois. Any political committee that receives such a 18 contribution shall forward it immediately to the State 19 Treasurer. 20 (c) Any person who knowingly makes an anonymous 21 contribution or a contribution in the name of another person 22 is guilty of a Class A misdemeanor and may be fined an amount -2- LRB9201906MWpkam 1 no greater than 3 times the amount of the prohibited 2 contribution. 3 (d) For the purposes of this Section, "contribution in 4 the name of another person" means a contribution in which (i) 5 the source of the contribution and (ii) the person or entity 6 causing the contribution to be made are not reported under 7 this Article. 8 (Source: P.A. 78-1183.) 9 (10 ILCS 5/9-25.5 new) 10 Sec. 9-25.5. Contributions from foreign nationals 11 prohibited. No candidate or political committee may solicit, 12 accept, or receive, directly or indirectly, a contribution 13 made by a foreign national. For the purposes of this Section, 14 "foreign national" means (i) a government of a foreign 15 country and a foreign political party; (ii) a person outside 16 of the United States, unless it established that the person 17 is an individual and a citizen of and domiciled within the 18 United States, or that the person is not an individual and is 19 organized under or created by the laws of the United States 20 or of any State or other place subject to the jurisdiction of 21 the United States and has its principal place of business 22 within the United States; (iii) a partnership, association, 23 corporation, organization, or other combination of persons 24 organized under the laws of or having its principal place of 25 business in a foreign country; and (iv) an individual who is 26 not a citizen of the United States and who is not lawfully 27 admitted for permanent residence, as defined in Section 28 1101(a)(20) of Title 8 of the United States Code. The term 29 "foreign national" does not include any individual who is a 30 citizen of the United States. 31 Section 99. Effective date. This Act takes effect upon 32 becoming law.".
