 1        AN ACT concerning the environment.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  MTBE  Elimination  Act  is  amended by
 5    changing Sections 10 and 15 as follows:

 6        (415 ILCS 122/10)
 7        Sec. 10. Definitions.  As used in this Act:
 8        "MTBE" means methyl tertiary butyl ether.
 9        "Agency"  means  the  Illinois  Environmental  Protection
10    Agency.
11        "Trace amount" means an  amount  not  exceeding  0.5%  by
12    volume of the motor fuel.

15        Sec.  15. MTBE Prohibitions.  Beginning 3 years after the
16    effective date of this Act, no person shall use, sell,  offer
17    for  sale,  distribute,  blend, or manufacture MTBE as a fuel
18    additive in Illinois.  It is not a violation of this Act  for
19    a  person  to  sell,  offer  for sale, distribute, or blend a
20    motor fuel in Illinois containing a trace amount of MTBE.

22        Section 99.  Effective date.  This Act takes effect  upon
23    becoming law.
