92_HB3984 LRB9213683AGmb 1 AN ACT concerning animals. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Animal Control Act is amended by adding 5 Section 16.5 as follows: 6 (510 ILCS 5/16.5 new) 7 Sec. 16.5. Injury or death; criminal offense. A person 8 commits a Class 4 felony if that person negligently, 9 recklessly, knowingly, or intentionally allows a dog or other 10 animal to cross the property line of the premises where the 11 dog or other animal is being kept, including reaching over or 12 under any fence, if that dog or other animal, unprovoked, 13 causes great bodily harm, disfigurement, disability, or death 14 to another person, and if that other person was in a place 15 where he or she may lawfully be. It is a rebuttable 16 presumption that the dog or other animal was unprovoked.
