92_HB4008 LRB9213968EGfg 1 AN ACT in relation to public employee benefits. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Pension Code is amended by 5 changing Section 5-167.4 as follows: 6 (40 ILCS 5/5-167.4) (from Ch. 108 1/2, par. 5-167.4) 7 Sec. 5-167.4. Widow annuitant minimum annuity. 8 (a) Notwithstanding any other provision of this Article, 9 beginning January 1, 1996, the minimum amount of widow's 10 annuity payable to any person who is entitled to receive a 11 widow's annuity under this Article is $700 per month, without 12 regard to whether the deceased policeman is in service on or 13 after the effective date of this amendatory Act of 1995. 14 Notwithstanding any other provision of this Article, 15 beginning January 1, 1999, the minimum amount of widow's 16 annuity payable to any person who is entitled to receive a 17 widow's annuity under this Article is $800 per month, without 18 regard to whether the deceased policeman is in service on or 19 after the effective date of this amendatory Act of 1998. 20 Notwithstanding any other provision of this Article, 21 beginning January 1, 2003, the minimum amount of widow's 22 annuity payable to any person who is entitled to receive a 23 widow's annuity under this Article is $1,200 per month, 24 without regard to whether the deceased policeman is in 25 service on or after the effective date of this amendatory Act 26 of the 92nd General Assembly. 27 (b) Effective January 1, 1994, the minimum amount of 28 widow's annuity shall be $700 per month for the following 29 classes of widows, without regard to whether the deceased 30 policeman is in service on or after the effective date of 31 this amendatory Act of 1993: (1) the widow of a policeman who -2- LRB9213968EGfg 1 dies in service with at least 10 years of service credit, or 2 who dies in service after June 30, 1981; and (2) the widow of 3 a policeman who withdraws from service with 20 or more years 4 of service credit and does not withdraw a refund, provided 5 that the widow is married to the policeman before he 6 withdraws from service. 7 (c) The city, in addition to the contributions otherwise 8 made by it under the other provisions of this Article, shall 9 make such contributions as are necessary for the minimum 10 widow's annuities provided under this Section in the manner 11 prescribed in Section 5-175. 12 (Source: P.A. 89-12, eff. 4-20-95; 90-766, eff. 8-14-98.) 13 Section 90. The State Mandates Act is amended by adding 14 Section 8.26 as follows: 15 (30 ILCS 805/8.26 new) 16 Sec. 8.26. Exempt mandate. Notwithstanding Sections 6 17 and 8 of this Act, no reimbursement by the State is required 18 for the implementation of any mandate created by this 19 amendatory Act of the 92nd General Assembly. 20 Section 99. Effective date. This Act takes effect upon 21 becoming law.
