1 AN ACT in relation to support.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5 changing Section 10-10.1 as follows:
6 (305 ILCS 5/10-10.1) (from Ch. 23, par. 10-10.1)
7 Sec. 10-10.1. Public Aid Collection Fee. In all cases
8 instituted by the Illinois Department on behalf of a child or
9 spouse, other than one receiving a grant of financial aid
10 under Article IV, on whose behalf an application has been
11 made and approved for support services as provided by Section
12 10-1, the court shall impose a collection fee on the
13 individual who owes a child or spouse support obligation in
14 an amount equal to 10% of the amount so owed as long as such
15 collection is required by federal law, which fee shall be in
16 addition to the support obligation. The imposition of the
17 such fee shall be in accordance with provisions of Title IV,
18 Part D, of the Social Security Act and regulations duly
19 promulgated thereunder. The fee shall be payable to the
20 clerk of the circuit court for transmittal to the Illinois
21 Department and shall continue until support services are
22 terminated by the Department.
