 1        AN ACT in relation to highways.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Illinois  Highway  Code  is  amended  by
 5    changing Section 5-902 as follows:

 6        (605 ILCS 5/5-902) (from Ch. 121, par. 5-902)
 7        Sec.  5-902.   General  purposes.   The  General Assembly
 8    finds that the purpose of this legislation is to  create  the
 9    authority   for  units  of  local  government  to  adopt  and
10    implement  road  improvement  impact   fee   ordinances   and
11    resolutions. The General Assembly further recognizes that the
12    imposition  of  such road improvement impact fees is designed
13    to supplement other funding sources so  that  the  burden  of
14    paying  for  road improvements can be allocated in a fair and
15    equitable manner.  It is the intent of the  General  Assembly
16    to  promote  orderly  economic growth throughout the State by
17    assuring that new development bears its  fair  share  of  the
18    cost  of meeting the demand for road improvements through the
19    imposition of road improvement impact fees.  It is  also  the
20    intent  of  the General Assembly to preserve the authority of
21    elected local government officials  to  adopt  and  implement
22    road  improvement  impact fee ordinances or resolutions which
23    adhere to the minimum standards  and  procedures  adopted  in
24    this Division by the State.
