92_HB4433 LRB9214763AGmb 1 AN ACT concerning agriculture. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 1. Short title. This Act may be cited as the 5 Agriculture Fair Practice Act. 6 Section 5. Definitions. As used in this Act: 7 "Department" means the Department of Agriculture of the 8 State of Illinois. 9 "Terminator or suicide genes" means a specific genetic 10 sequence inserted into a seed's DNA that, once activated by a 11 synthetic chemical catalyst of the manufacturer's choosing, 12 renders the seed and the crop it produces sterile. 13 Section 10. Seed DNA. 14 (a) Farmers may keep seed DNA alive and may use that 15 seed DNA for more than one growing season if the farmer (i) 16 purchased the seed DNA and (ii) will use the seed DNA only 17 for his or her own use. 18 (b) Seed producers may not require a farmer to lease 19 seed DNA or otherwise impose terms restricting its use to 20 only a limited time period. Any such terms are void. 21 Section 15. Truth in pricing guidelines. The Department, 22 by rule, must implement truth in pricing guidelines to even 23 out the disparity between the input costs paid by American 24 farmers and the input costs paid by foreign farmers. 25 Section 20. Terminator genes; suicide genes. Seed 26 producers may not introduce terminator or suicide genes into 27 Illinois unless the General Assembly, by law, grants the 28 authority to do so. -2- LRB9214763AGmb 1 Section 99. Effective date. This Act takes effect upon 2 becoming law.
