1 AN ACT in relation to child support.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Illinois Public Aid Code is amended by
5 changing Section 10-21 as follows:
6 (305 ILCS 5/10-21) (from Ch. 23, par. 10-21)
7 (Section scheduled to be repealed on July 1, 2002)
8 Sec. 10-21. One-time charge. The Illinois Department
9 may provide by rule for the imposition of a one-time charge
10 of 20% of the amount of past-due child support owed on July
11 1, 1988, by responsible relatives of persons receiving
12 support services under this Article X, which has accrued
13 under a support order entered by a court or administrative
14 body of this or any other State, on behalf of resident or
15 non-resident persons. The rule shall provide for notice to,
16 and an opportunity to be heard by, the responsible relative
17 affected and any final administrative decision rendered by
18 the Department shall be reviewed only under and in accordance
19 with the Administrative Review Law. No action to impose the
20 charge shall be commenced after June 30, 1993. Action under
21 this Section shall be subject to the limitations of Section
22 10-20 of this Code.
23 This Section is repealed on July 1, 2002.
