92_HB4778 LRB9211968BDdv 1 AN ACT in relation to sanitary districts. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Sanitary District Act of 1907 is amended 5 by changing Section 1 as follows: 6 (70 ILCS 2205/1) (from Ch. 42, par. 247) 7 Sec. 1. Petition to incorporate as a sanitary district. 8 Whenever any area of contiguous territory within the limits 9 of two counties, having within its limits two or more 10 incorporated cities or villages, and an aggregate population 11 of not less than 3,500 inhabitants, shall be so situate as to 12 be subject to overflow from any river or tributary thereof, 13 and the maintenance of one or more levees for the protection 14 of the same against such overflow, and of a new or improved 15 outlet for the drainage thereof, will conduce to the 16 preservation of the public health and safety, the same may be 17 incorporated as a sanitary district, in the manner following: 18 Any three hundred legal voters resident within the limits of 19 such proposed district, may petition the circuit court for 20 the county in which the majority of such petitioners reside, 21 to cause the question to be submitted to the legal voters of 22 said proposed district, whether they will organize as a 23 sanitary district under this act. Such petition shall contain 24 the name of such proposed sanitary district, and a definite 25 description of the territory intended to be embraced therein: 26 Provided, no territory shall be included within more than one 27 sanitary district under this act. 28 (Source: Laws 1967, p. 3817.)
