92_HB4795 LRB9211982BDsb 1 AN ACT concerning plan commissions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Municipal Code is amended by 5 changing Section 11-12-12 as follows: 6 (65 ILCS 5/11-12-12) (from Ch. 24, par. 11-12-12) 7 Sec. 11-12-12. No map or plat of any subdivision 8 presented for record affecting land (1) within the corporate 9 limits of any municipality thatwhichhas heretofore adopted, 10 or shall hereafter adopt an ordinance including an official 11 map in the manner prescribed in this Division 12, or (2) 12 within contiguous territory which is not more than 1 1/2 13 miles beyond the corporate limits of an adopting 14 municipality, shall be entitled to record or shall be valid 15 unless the subdivision shown thereon provides for streets, 16 alleys, public ways, ways for public service facilities, 17 storm and flood water run-off channels and basins, and public 18 grounds, in conformity with the applicable requirements of 19 the ordinances including the official map; provided, that a 20 certificate of approval by the corporate authorities, 21 certified by the clerk of the municipality in whose 22 jurisdiction the land is located, or a certified copy of an 23 order of the circuit court directing the recording as 24 provided in Section 11-12-8, shall be sufficient evidence of 25 compliance with this section upon which the recorder may 26 accept the plat for recording. 27 The provisions of this Section do not apply to any plat 28 for consolidation of 2 or more contiguous parcels, located 29 within any territory that is outside of the corporate limits 30 of a municipality but within a county that has adopted a 31 subdivision ordinance and that has a population of more than -2- LRB9211982BDsb 1 250,000, into a smaller number of parcels if the sole purpose 2 of the consolidation is to bring a non-conforming parcel into 3 conformance with local zoning requirements. The exemption 4 created by this amendatory Act of the 92nd General Assembly 5 does not apply to a plat for consolidation for an area in 6 excess of 10 acres or to any consolidation that results in a 7 plat of more than 10 individual lots following the 8 consolidation. If the county receives a request to approve a 9 plat for consolidation pursuant to this Section, the county 10 must notify all municipalities located within 1 1/2 miles of 11 the subject property within 10 days after receiving the 12 request. 13 (Source: P.A. 92-361, eff. 1-1-02.)
