1 AMENDMENT TO HOUSE BILL 4870
2 AMENDMENT NO. . Amend House Bill 4870 by replacing
3 everything after the enacting clause with the following:
4 "Section 5. The Illinois Dental Practice Act is amended
5 by adding Section 8.2 as follows:
6 (225 ILCS 25/8.2 new)
7 (Section scheduled to be repealed on January 1, 2006)
8 Sec. 8.2. Use of mercury amalgam fillings.
9 (a) A dentist may not place a mercury or mercury amalgam
10 filling in any person 18 years of age or younger, any woman
11 45 years of age or younger, or any woman who is pregnant.
12 (b) A dentist may not use mercury or mercury amalgam in
13 a dental procedure unless, prior to the use, the dentist
14 informs the patient, in a manner that in the dentist's
15 professional judgment will be understood by the patient, of
16 all of the following:
17 (1) The intended use of mercury or mercury amalgam.
18 (2) The potential advantages and disadvantages of
19 the use of the mercury or mercury amalgam that relate to
20 health, human biological, or environmental issues.
21 (3) The options for completing the dental procedure
22 using materials other than mercury or mercury amalgam.

1 (c) A dentist shall post in the public area of his or
2 her dental office a warning about the dangers of exposure to
3 mercury posed by mercury amalgam fillings. The required
4 minimum information to be posted shall be determined in rules
5 adopted by the Department.".
