92_HB4872 LRB9211920ACcd 1 AN ACT concerning the regulation of professions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Dietetic and Nutrition Services Practice 5 Act is amended by changing Section 15.5 as follows: 6 (225 ILCS 30/15.5) 7 (Section scheduled to be repealed on December 31, 2002) 8 Sec. 15.5. Unlicensed practice; violation; civil 9 penalty. 10 (a) Any person who practices, offers to practice, 11 attempts to practice, or holds oneself out to practice 12 dietetics or nutrition counseling without being licensed 13 under this Act shall, in addition to any other penalty 14 provided by law, pay a civil penalty to the Department in an 15 amount not to exceed $5,000 for each offense as determined by 16 the Department. The civil penalty shall be assessed by the 17 Department after a hearing is held in accordance with the 18 provisions set forth in this Act regarding the provision of a 19 hearing for the discipline of a licensee. 20 (b) The Department has the authority and power to 21 investigate anyand allunlicensed activity. 22 (c) The civil penalty shall be paid within 60 days after 23 the effective date of the order imposing the civil penalty. 24 The order shall constitute a judgment and may be filed and 25 execution had thereon in the same manner as any judgment from 26 any court of record. 27 (Source: P.A. 89-474, eff. 6-18-96.)
