1 AMENDMENT TO HOUSE BILL 5057
2 AMENDMENT NO. . Amend House Bill 5057 by replacing
3 the title with the following:
4 "AN ACT creating the Naperville Park District Tax Levy
5 Validation (1997) Act."; and
6 by replacing everything after the enacting clause with the
7 following:
8 "Section 1. Short title. This Act may be cited as the
9 Naperville Park District Tax Levy Validation (1997) Act.
10 Section 5. The Naperville Park District having during
11 1997 adopted an annual levy ordinance within the time
12 required by law for the subject fiscal year, having levied
13 sums of money as required to defray all the necessary
14 expenses and liabilities of the District for the subject
15 fiscal year, and having passed an annual budget and
16 appropriation and tax levy ordinance and certified the same
17 to the County Clerks of DuPage and Will Counties, Illinois,
18 within the time required by law, the appropriation ordinance
19 and the tax levy ordinance, together with the taxes assessed,
20 levied, and extended thereunder are hereby validated,
21 ratified, and declared to be in full force and effect,

1 notwithstanding that the notice published by the Park
2 District deviated from the notice requirements of the Truth
3 in Taxation Law of the Property Tax Code by: (i) omitting the
4 words "or abated" in Division II; (ii) omitting a sentence in
5 Division IV; and (iii) adding the word "Notice" as a title at
6 the top of the notice.
7 Section 10. Nothing in this Act shall be construed as
8 validating any tax levy in excess of the rate of taxation
9 authorized by law for any fiscal year or for any purpose not
10 permitted by the Illinois Constitution.".
