92_HB5127eng HB5127 Engrossed LRB9212166JMmb 1 AN ACT concerning freedom of information. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Freedom of Information Act is amended by 5 changing Section 10 as follows: 6 (5 ILCS 140/10) (from Ch. 116, par. 210) 7 Sec. 10. Denial of requests; appeal. 8 (a) Any person denied access to inspect or copy any 9 public record may appeal the denial by sending a written 10 notice of appeal to the head of the public body. Upon 11 receipt of such notice the head of the public body shall 12 promptly review the public record, determine whether under 13 the provisions of this Act such record is open to inspection 14 and copying, and notify the person making the appeal of such 15 determination within 7 working days after the notice of 16 appeal. 17 (b) Any person making a request for public records shall 18 be deemed to have exhausted his administrative remedies with 19 respect to such request if the head of the public body 20 affirms the denial or fails to act within the time limit 21 provided in subsection (a) of this Section. 22 (Source: P.A. 83-1013.)
