 1        AN ACT in relation to public employee benefits.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Illinois  Pension  Code  is  amended  by
 5    changing Section 14-126 as follows:

 6        (40 ILCS 5/14-126) (from Ch. 108 1/2, par. 14-126)
 7        Sec.     14-126.      Retirement     annuity    following
 8    nonoccupational  disability  benefit.  Rights  on  expiration
 9    -Retirement annuity option on re-entry.  Any member having 15
10    or more years of creditable service, and having  attained  at
11    least  age  55,  or  having  20  or  more years of creditable
12    service and having attained  at  least  age  50,  who,  after
13    receiving  nonoccupational disability benefit for the maximum
14    period  of  time  specified  herein  is  still  disabled  for
15    service, shall be entitled to receive  a  retirement  annuity
16    beginning  the  first  of  the  month  following application,
17    without regard to whether the member has attained age 60.
18        If  a  member  having  15  but  less  than  20  years  of
19    creditable service  is  under  age  55  when  nonoccupational
20    disability  benefits  terminate,  and  the  member  has  been
21    continuously  disabled  for  service,  the member is entitled
22    upon application to the retirement annuity upon the first  of
23    the month after attainment of age 55.
24        If a member having 20 or more years of creditable service
25    is  under  age  50  when  nonoccupational disability benefits
26    terminate, and the member has been continuously disabled  for
27    service,  the  member  is  entitled  upon  application to the
28    retirement annuity beginning upon  the  first  of  the  month
29    after attainment of age 50.
30        As  an  option to the computation of a retirement annuity
31    in the manner provided in  this  Article,  if  a  person  who

 1    retires  on  a  retirement  annuity prior to age 60 under the
 2    provisions of this Section re-enters State  employment,  that
 3    person  may  refund  to  the  system  the  amount theretofore
 4    received  as  a  retirement  annuity  and  upon  subsequently
 5    retiring from State service shall be entitled to a retirement
 6    annuity computed as though that  member  had  not  previously
 7    received such annuity.
