92_HB5473 LRB9214077SMtm 1 AN ACT in relation to aging. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Senior Citizens and Disabled Persons 5 Property Tax Relief and Pharmaceutical Assistance Act is 6 amended by changing Section 5 as follows: 7 (320 ILCS 25/5) (from Ch. 67 1/2, par. 405) 8 Sec. 5. Procedure. 9 (a) In general. Claims must be filed after January 1, 10 on forms prescribed by the Department. No claim may be filed 11 more than one year after December 31 of the year for which 12 the claim is filed except that claims for 1976 may be filed 13 until December 31, 1978. The pharmaceutical assistance 14 identification card provided for in subsection (f) of Section 15 4 shall be valid for a period not to exceed one year. On and 16 after January 1, 2002, however, to enable the Department to 17 convert coverage for a pharmaceutical assistance program 18 participant to a State fiscal year basis, a card shall be 19 valid for a longer or shorter period than 12 months, 20 depending on the date a timely claim is filed and as 21 determined by the Department. All applicants for benefits 22 under this program approved for benefits on or after July 1 23 but on or before December 31 of any State fiscal year are 24 eligible for benefits through June 30 of that State fiscal 25 year. All applicants for benefits under this program 26 approved for benefits on or after January 1 but on or before 27 June 30 of any State fiscal year are eligible for benefits 28 through June 30 of the following State fiscal year. 29 (b) Claim is Personal. The right to file a claim under 30 this Act shall be personal to the claimant and shall not 31 survive his death, but such right may be exercised on behalf -2- LRB9214077SMtm 1 of a claimant by his legal guardian or attorney-in-fact. If 2 a claimant dies after having filed a timely claim, the amount 3 thereof shall be disbursed to his surviving spouse or, if no 4 spouse survives, to his surviving dependent minor children in 5 equal parts, provided the spouse or child, as the case may 6 be, resided with the claimant at the time he filed his claim. 7 If at the time of disbursement neither the claimant nor his 8 spouse is surviving, and no dependent minor children of the 9 claimant are surviving the amount of the claim shall escheat 10 to the State. 11 (c) One claim per household. Only one member of a 12 household may file a claim under this Act in any calendar 13 year; where both members of a household are otherwise 14 entitled to claim a grant under this Act, they must agree as 15 to which of them will file a claim for that year. 16 (d) Content of application form. The form prescribed by 17 the Department for purposes of paragraph (a) shall include a 18 table, appropriately keyed to the parts of the form on which 19 the claimant is required to furnish information, which will 20 enable the claimant to determine readily the approximate 21 amount of grant to which he is entitled by relating levels of 22 household income to property taxes accrued or rent 23 constituting property taxes accrued. 24 (e) Pharmaceutical Assistance Procedures. The 25 Department shall establish the form and manner for 26 application,and shall establish by January 1, 1986 a 27 procedure to enable persons to apply for the additional grant 28 or for the pharmaceutical assistance identification card on 29 the same application form. The Department shall determine 30 eligibility for pharmaceutical assistance using the 31 applicant's current income.
