92_HB5599ham001 LRB9214228NTpkam 1 AMENDMENT TO HOUSE BILL 5599 2 AMENDMENT NO. . Amend House Bill 5599 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Higher Education Student Assistance Act 5 is amended by adding Section 65.70 as follows: 6 (110 ILCS 947/65.70 new) 7 Sec. 65.70. Career criminal justice attorney education 8 expenses repayment. 9 (a) As used in this Section: 10 "Eligible attorney" means an attorney who is employed 11 full-time as an assistant State's attorney, assistant public 12 defender, assistant appellate defender, assistant appellate 13 prosecutor, or assistant attorney general whose application 14 under subsection (b) of this Section has been accepted and 15 authorized by the Commission to receive assistance in the 16 repayment of his or her student education expenses. 17 "Student education expenses" means the cumulative total 18 of the eligible attorney's outstanding student loans covering 19 the cost of attendance at any law school at which the 20 attorney completed course work required to obtain his or her 21 law degree. 22 (b) An eligible attorney may apply to the Commission on -2- LRB9214228NTpkam 1 forms furnished by the Commission for an annual stipend to 2 repay his or her student education expenses. 3 To be accepted for a stipend, an eligible attorney must 4 meet the following qualifications: 5 (1) the attorney is currently licensed to practice 6 law in the State of Illinois; 7 (2) the attorney signs a statement agreeing to 8 remain in his or her present employment for at least one 9 year after receiving the stipend; and 10 (3) the attorney attaches verification of his or 11 her outstanding student loans. 12 An eligible attorney must apply each year for a stipend 13 for student education expenses repayment. 14 The amount of the annual stipend is $3,500 or the 15 outstanding balance of the eligible attorney's student loans, 16 whichever is less, and may be received by an eligible 17 attorney for 5 years. In addition, an eligible attorney who 18 has received 5 annual stipends may receive an additional 7 19 annual stipends in the amount of $5,000 per year or the 20 outstanding balance of his or her student loans, whichever is 21 less. 22 The amount of the annual stipend shall be adjusted for 23 inflation each July 1 using the Consumer Price Index of the 24 Bureau of Labor Standards of the U.S. Department of Labor. 25 If an eligible attorney receives a stipend and resigns 26 his or her position, the eligible attorney must repay to the 27 State 1/12th of the amount of the annual stipend for each 28 month left in the stipend year that he or she was not an 29 eligible attorney. 30 (c) The General Assembly shall make appropriations to 31 the Commission for annual stipends under this Section. 32 (d) The Commission must adopt rules for the 33 implementation of this Section. -3- LRB9214228NTpkam 1 Section 99. Effective date. This Act takes effect on 2 July 1, 2003.".
