92_HB5935eng HB5935 Engrossed LRB9214832RCcd 1 AN ACT in relation to criminal law. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Unified Code of Corrections is amended by 5 adding Section 5-9-1.12 as follows: 6 (730 ILCS 5/5-9-1.12 new) 7 Sec. 5-9-1.12. Arson, residential arson, and aggravated 8 arson fines. 9 (a) In addition to any other penalty imposed, a fine of 10 $500 shall be imposed upon a person who is convicted of 11 arson, residential arson, or aggravated arson. 12 (b) The additional amount shall be assessed by the court 13 imposing sentence and shall be collected by the circuit 14 clerk. Each additional fine imposed under this Section shall 15 be remitted by the circuit clerk within one month after 16 receipt to the county treasurer for deposit in the county 17 treasury in a separate account to be distributed by the 18 county treasurer to the fire department or fire protection 19 district that suppressed or investigated the fire that was 20 set by the defendant and for which the defendant was 21 convicted of arson, residential arson, or aggravated arson. 22 If more than one fire department or fire protection district 23 suppressed or investigated the fire, the additional fine 24 shall be distributed equally among those departments or 25 districts. The departments and districts may only use these 26 moneys to purchase fire suppression or fire investigation 27 equipment.
