92_HB6004 LRB9213741DHmgA 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The State Finance Act is amended by adding 5 Section 5.570 as follows: 6 (30 ILCS 105/5.570 new) 7 Sec. 5.570. The Black Fraternity and Sorority 8 Scholarship Fund. 9 Section 10. The Illinois Vehicle Code is amended by 10 adding Section 3-654 as follows: 11 (625 ILCS 5/3-654 new) 12 Sec. 3-654. Black Fraternity and Sorority license 13 plates. 14 (a) The Secretary, upon receipt of all applicable fees 15 and applications made in the form prescribed by the 16 Secretary, may issue special registration plates designated 17 as Black Fraternity and Sorority license plates. The 18 special plates issued under this Section shall be affixed 19 only to passenger vehicles of the first division or motor 20 vehicles of the second division weighing not more than 8,000 21 pounds. Plates issued under this Section shall expire 22 according to the multi-year procedure established by Section 23 3-414.1 of this Code. 24 (b) The design and color of the special plates shall be 25 wholly within the discretion of the Secretary. The 26 Secretary may, in his or her discretion, allow the plates to 27 be issued as vanity or personalized plates in accordance with 28 Section 3-405.1 of this Code. The plates are not required to 29 designate "Land of Lincoln", as prescribed in subsection (b) -2- LRB9213741DHmgA 1 of Section 3-412 of this Code. The Secretary, in his or her 2 discretion, shall approve and prescribe stickers or decals as 3 provided under Section 3-412. 4 (c) An applicant for the special plate shall be charged 5 a $40 fee for original issuance in addition to the 6 appropriate registration fee. Of this fee, $25 shall be 7 deposited into the Black Fraternity and Sorority Scholarship 8 Fund and $15 shall be deposited into the Secretary of State 9 Special License Plate Fund, to be used by the Secretary to 10 help defray the administrative processing costs. 11 For each registration renewal period, a $27 fee, in 12 addition to the appropriate registration fee, shall be 13 charged. Of this fee, $25 shall be deposited into the Black 14 Fraternity and Sorority Scholarship Fund and $2 shall be 15 deposited into the Secretary of State Special License Plate 16 Fund. 17 (d) The Black Fraternity and Sorority Scholarship Fund 18 is created as a special fund in the State treasury. Subject 19 to appropriation by the General Assembly and approval by the 20 Secretary, the Illinois Student Assistance Commission shall 21 use all moneys in the Black Fraternity and Sorority 22 Scholarship Fund to provide grants for scholarships for 23 higher education. A scholarship recipient must meet 24 academic, financial, and other requirements established by 25 the Commission and must be an Illinois resident.
