 1        AN ACT in relation to children.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The  Children  and  Family  Services  Act  is
 5    amended by adding Section 5.25 as follows:

 6        (20 ILCS 505/5.25 new)
 7        Sec. 5.25.  Child on ventilator; discharge from hospital.
 8    If  (i)  a  child  is medically ready to be discharged from a
 9    hospital and  is  dependent  upon  a  ventilator  to  support
10    breathing  and (ii) the Department is responsible for placing
11    the child upon discharge from the hospital but  cannot  place
12    the  child  immediately  upon discharge, with the result that
13    the child remains in the  hospital  pending  placement,  then
14    until  the child is discharged in accordance with a placement
15    by the Department, the Department must continue to  reimburse
16    the  hospital for care provided to the child at the same rate
17    at which the Department reimburses the hospital for inpatient
18    services.

19        Section 10. The Illinois Public Aid Code  is  amended  by
20    adding Section 5-23 as follows:

21        (305 ILCS 5/5-23 new)
22        Sec. 5-23.  Child on ventilator; discharge from hospital.
23    If (i) a hospitalized child is dependent upon a ventilator to
24    support  breathing  and  that  child  is  medically ready for
25    discharge  from  a  hospital  but  does  not  have   a   home
26    environment  ready  to  support  his or her medical needs and
27    (ii) that child is a ward of the Department of  Children  and
28    Family Services or is a recipient of medical assistance under
29    this  Article  V,  then the Department of Children and Family

 1    Services or the Department of Public  Aid  must  continue  to
 2    reimburse  the hospital for the care provided to the child at
 3    the same rate at which the respective  department  reimburses
 4    the hospital for inpatient services.
