92_HC0010 LRB9213597NTsb 1 HOUSE JOINT RESOLUTION 2 CONSTITUTIONAL AMENDMENT 3 RESOLVED, BY THE HOUSE OF REPRESENTATIVES OF THE 4 NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE 5 SENATE CONCURRING HEREIN, that there shall be submitted to 6 the electors of the State for adoption or rejection at the 7 general election next occurring at least 6 months after the 8 adoption of this resolution a proposition to amend Section 2 9 of Article X of the Constitution as follows: 10 ARTICLE X 11 EDUCATION 12 (ILCON Art. X, Sec. 2) 13 SECTION 2. STATE BOARD OF EDUCATION - STATE SUPERINTENDENT OF 14 EDUCATIONCHIEF STATE EDUCATIONAL OFFICER15 (a) There is created a State Board of Education to be 16 elected or selected on a regional basis. The number of 17 members, their qualifications, terms of office and manner of 18 election or selection shall be provided by law. The Board, 19 except as limited by law, may establish goals, determine 20 policies, provide for planning and evaluating education 21 programs and recommend financing. The Board shall have such 22 other duties and powers as provided by law. 23 (b) A State Superintendent of Education shall be 24 nominated at a general primary election and elected by the 25 electors of the State at the general election every 4 years, 26 beginning in 2004. The State Superintendent of Education 27 shall hold office for 4 years beginning on the second Monday 28 of January after his or her election. To be eligible to hold 29 the office of State Superintendent of Education a person must 30 be a United States citizen, at least 25 years old, and a 31 resident of the State for 10 years preceding his or her 32 election. -2- LRB9213597NTsb 1 The names of the candidates for State Superintendent of 2 Education shall be printed on the ballot directly below the 3 names of the candidates for Secretary of State. 4 Any vacancy in the office of State Superintendent of 5 Education shall be filled in the manner provided in Section 7 6 of Article V. 7 The State Superintendent shall be the chief educational 8 officer of the State.The State Board of Education shall9appoint a chief state educational officer.10 (Source: Illinois Constitution.) 11 SCHEDULE 12 This Constitutional Amendment takes effect upon being 13 declared adopted in accordance with Section 7 of the Illinois 14 Constitutional Amendment Act, and when the State 15 Superintendent of Education initially elected under Section 2 16 of Article X of the Illinois Constitution takes office, the 17 term of office of the chief state educational officer 18 appointed by the State Board of Education shall expire.
