 1                AMENDMENT TO HOUSE JOINT RESOLUTION 2

 2        AMENDMENT NO.     .  Amend House Joint  Resolution  2  by
 3    replacing lines 2 through 31 on page 1 and all of page 2 with
 4    the following:
 5        "WHEREAS,  Public  Act 91-930 amended the Illinois Income
 6    Tax Act  to  create  employer  income  tax  credits  for  the
 7    construction and operation of employee child care facilities;
 8    and

 9        WHEREAS,  The  Act  provides  for  a credit of 30% of the
10    start-up costs expended by a corporation to provide  a  child
11    care  facility for the children of its employees; this credit
12    is available beginning with taxable years ending on or  after
13    December 31, 2000; and

14        WHEREAS,  The Act provides for an additional credit of 5%
15    of the annual amount paid by the corporation in providing the
16    child care facility for employees' children; this  credit  is
17    available  beginning  with  taxable  years ending on or after
18    December 31, 2000 and does not have an expiration date; and

19        WHEREAS, The Act provides that, to be  eligible  for  the
20    credit,  a  corporation  may provide and operate a child care
21    facility independently or in partnership  with  one  or  more
22    other  corporations;  the Act limits the credit to child care

 1    facilities located in Illinois; and

 2        WHEREAS, The Governor's Children  and  Family  Leadership
 3    Subcabinet, in its Year One Report, recognizes the importance
 4    of  family-friendly  workplaces and recommends that the State
 5    work to promote employers that assist employees in  balancing
 6    work and family life; and

 7        WHEREAS,  Studies  have  shown  that  employers providing
 8    child care services report improved employee recruitment  and
 9    retention; and

10        WHEREAS,  It  is  in the best interest of the citizens of
11    Illinois that the State promote the availability  of  quality
12    child care for the taxpayers of Illinois; therefore be it

13        RESOLVED,   BY   THE  HOUSE  OF  REPRESENTATIVES  OF  THE
14    NINETY-SECOND GENERAL ASSEMBLY OF THE STATE OF ILLINOIS,  THE
15    SENATE CONCURRING HEREIN, that the Department of Commerce and
16    Community  Affairs,  in  cooperation  with  the Department of
17    Revenue,  shall  track  and  monitor  the  use  by   Illinois
18    employers  of the tax credits for employee child care created
19    by Public Act 91-930; and be it further

20        RESOLVED,  That  there  is  created  the  Family-Friendly
21    Workplace Task Force; and be it further

22        RESOLVED, That the task force shall  be  composed  of  12
23    members  appointed by the Lieutenant Governor of the State of
24    Illinois, who shall serve as Chairperson; and be it further

25        RESOLVED, That the Family-Friendly Workplace  Task  Force
26    shall  publicize  the availability of the tax credits created
27    by Public Act  91-930;  shall  examine  the  availability  of
28    family-friendly   workplace   incentives   in  Illinois,  the
29    effectiveness of tax credits for employee child care  created
30    by Public Act 91-930, and appropriate scholarly, statistical,
31    and  other  materials  relating  to  these  issues  and  laws

 1    relating  thereto;  shall  evaluate  the data gathered by the
 2    Department  of  Commerce  and  Community  Affairs   and   the
 3    Department of Revenue in regards to the use of the tax credit
 4    created  by  Public  Act  91-930; shall study any significant
 5    problems that have arisen regarding the use  of  this  credit
 6    and  other  family-friendly workplace incentives in Illinois;
 7    and shall develop recommendations for addressing any problems
 8    it determines to be significant; and be it further

 9        RESOLVED, That the Department of Commerce  and  Community
10    Affairs, in cooperation with the Department of Revenue, shall
11    report  to  the Children and Family Leadership Subcabinet and
12    the Family-Friendly Workplace Task Force by  March  1,  2002,
13    and  each  March  1 thereafter, on the extent the credits are
14    used and, if the  credits  are  not  used  as  expected,  the
15    reasons  why  employers  are not using the credits; and be it
16    further

17        RESOLVED, That the Family-Friendly Workplace  Task  Force
18    shall  report its initial findings and recommendations to the
19    General Assembly by December 31, 2002, and shall  report  its
20    subsequent  findings  and  recommendations  by December 31 of
21    each year thereafter; and be it further

22        RESOLVED, That suitable  copies  of  this  resolution  be
23    delivered  to the Director of Commerce and Community Affairs,
24    the Director of Revenue, and the Governor.".
