 1                       HOUSE JOINT RESOLUTION

 2        WHEREAS, The Illinois Health Facilities Planning Act  was
 3    created  in  1974,  in  accordance  with federal mandates, to
 4    establish a procedure to  reverse  the  trend  of  increasing
 5    health  care costs resulting from unnecessary construction or
 6    modification  of  health  care  facilities,  to  improve  the
 7    financial ability of the public to  obtain  necessary  health
 8    services,  and  to  establish  an  orderly  and comprehensive
 9    health care delivery system providing  quality  health  care;
10    and

11        WHEREAS,  The  Health Facilities Planning Board currently
12    administers  the  Certificate  of  Need   program   for   the
13    regulation   of   ambulatory   surgical   treatment  centers,
14    hospitals,  nursing  homes,  and  kidney  disease   treatment
15    centers within the State of Illinois; and

16        WHEREAS,  The  health  care delivery system has undergone
17    drastic changes and witnessed numerous  advancements  in  the
18    past 25 years; and

19        WHEREAS,  Thirteen states have repealed their Certificate
20    of Need programs and many other states have scaled back their
21    Certificate of  Need  programs  by  limiting  the  scope  and
22    criteria for review under those programs; and

23        WHEREAS,  The  91st General Assembly approved Senate Bill
24    807, signed into law as Public Act 91-0782, which included  a
25    sunset  provision that repeals the Illinois Health Facilities
26    Planning  Act  on  July  1,  2003,  which  will   require   a
27    determination  by  the  General Assembly regarding the future
28    status of the law; therefore be it

29        RESOLVED,  BY  THE  HOUSE  OF  REPRESENTATIVES   OF   THE
30    NINETY-SECOND  GENERAL ASSEMBLY OF THE STATE OF ILLINOIS, THE
31    SENATE CONCURRING HEREIN, that there is created the  Illinois

 1    Legislative Task Force on Certificate of Need consisting of 5
 2    voting  members,  one of whom shall be a member of the Senate
 3    appointed by the President of the Senate and who shall  serve
 4    as  Co-chairperson,  one  of  whom  shall  be a member of the
 5    Senate appointed by the Minority Leader of the Senate, one of
 6    whom shall be  a  member  of  the  House  of  Representatives
 7    appointed  by the Speaker of the House of Representatives and
 8    who shall serve as Co-chairperson, one of  whom  shall  be  a
 9    member  of  the  House  of  Representatives  appointed by the
10    Minority Leader of the House of Representatives, and  one  of
11    whom  shall  be an Illinois health care consumer appointed by
12    the Governor and recommended by a statewide organization that
13    advocates for Illinois  health  care  consumers;  and  be  it
14    further

15        RESOLVED, That the Task Force shall include 12 non-voting
16    members,  one of whom shall be a representative designated by
17    the Illinois Hospital and Health Systems Association, one  of
18    whom  shall  be  a  representative designated by the Illinois
19    State Medical Society, one of whom shall be a  representative
20    designated by the Life Services Network, one of whom shall be
21    a  representative  designated  by  the  Illinois  Health Care
22    Association, one of whom shall be a representative designated
23    by the Illinois Council on Long Term Care, one of whom  shall
24    be  a representative designated by the Illinois State Chamber
25    of Commerce, one of whom shall be a representative designated
26    by the Freestanding Surgical  Treatment  Center  Association,
27    one  of  whom  shall  be  a  representative designated by the
28    Health Facilities Planning Board,  one of  whom  shall  be  a
29    representative designated by the Illinois Campaign for Better
30    Health Care, one of whom shall be a representative designated
31    by  the  Illinois  Nurses Association, one of whom shall be a
32    representative designated by a  collective  bargaining  agent
33    representing  Illinois  health  care workers, and one of whom
34    shall be a representative  designated  by  the  International

 1    Health Racquet and Sports Club Association; and be it further

 2        RESOLVED,  That  the  meetings of the Task Force shall be
 3    held at the call of the Co-chairpersons and that  members  of
 4    the  Task  Force  shall serve without compensation; and be it
 5    further

 6        RESOLVED, That the Task Force shall study the Certificate
 7    of Need process; and be it further

 8        RESOLVED,  That  the  Task   Force   shall   report   its
 9    recommendations  to  the  General Assembly and Governor on or
10    before January 9, 2002.
