 1        AN  ACT  concerning  presidential  and  vice-presidential
 2    electors.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The Election  Code  is  amended  by  changing
 6    Section 21-1 as follows:

 7        (10 ILCS 5/21-1) (from Ch. 46, par. 21-1)
 8        Sec. 21-1. Choosing and election of electors of President
 9    and  Vice-President  of  the  United  States  shall be in the
10    following manner:
11        (a)  In each year in which a President and Vice-President
12    of the United States are  chosen,  each  political  party  or
13    group  in  this  State  shall  choose by its State Convention
14    electors of President and Vice-President of the United States
15    and such State Convention of such party or group  shall  also
16    choose electors at large, if any are to be appointed for this
17    State  and such State Convention of such party or group shall
18    by its chairman and secretary certify the total list of  such
19    electors  together  with  electors  at large so chosen to the
20    State Board of Elections.
21        The filing of such certificate with the  Board,  of  such
22    choosing  of  electors  shall  be  deemed and taken to be the
23    choosing and selection of the electors of this State, if such
24    party or group is successful at the polls as herein  provided
25    in choosing their candidates for President and Vice-President
26    of the United States.
27        (b)  The names of the candidates of the several political
28    parties   or   groups   for   electors   of   President   and
29    Vice-President shall not be printed on the official ballot to
30    be  voted  in  the election to be held on the day in this Act
31    above named. In lieu of the names of the candidates for  such

 1    electors  of  President and Vice-President, immediately under
 2    the appellation of party name of a  party  or  group  in  the
 3    column  of its candidates on the official ballot, to be voted
 4    at said election first  above  named  in  subsection  (1)  of
 5    Section  2A-1.2  and  Section  2A-2,  there  shall be printed
 6    within a bracket the name of the candidate for President  and
 7    the name of the candidate for Vice-President of such party or
 8    group  with  a square to the left of such bracket. Each voter
 9    in this State from the several lists or sets of  electors  so
10    chosen  and selected by the said respective political parties
11    or groups, may choose and elect one of such lists or sets  of
12    electors  by placing a cross in the square to the left of the
13    bracket aforesaid of one of such parties or groups. Placing a
14    cross within the square  before  the  bracket  enclosing  the
15    names of President and Vice-President shall not be deemed and
16    taken  as a direct vote for such candidates for President and
17    Vice-President, or either of them, but shall only  be  deemed
18    and taken to be a vote for the entire list or set of electors
19    chosen  by  that political party or group so certified to the
20    State Board of Elections as herein provided. Voting by  means
21    of  placing  a  cross  in the appropriate place preceding the
22    appellation or title of the  particular  political  party  or
23    group,  shall not be deemed or taken as a direct vote for the
24    candidates for President and  Vice-President,  or  either  of
25    them, but instead to the Presidential vote, as a vote for the
26    entire list or set of electors chosen by that political party
27    or  group  so  certified  to  the State Board of Elections as
28    herein provided.
29        (c)  Such  certification  by  the  respective   political
30    parties  or groups in this State of electors of President and
31    Vice-President shall be made to the State Board of  Elections
32    within 2 days after such State convention.
33        (d)  Should  more  than  one  certificate  of  choice and
34    selection of electors of the same political party or group be

 1    filed by contesting  conventions  or  contesting  groups,  it
 2    shall  be  the duty of the State Board of Elections within 10
 3    days after the adjournment of the last of such conventions to
 4    meet and determine which set of nominees for electors of such
 5    party or group was chosen  and  selected  by  the  authorized
 6    convention of such party or group. The Board, after notice to
 7    the  chairman  and secretaries or managers of the conventions
 8    or groups and after a hearing shall determine  which  set  of
 9    electors was so chosen by the authorized convention and shall
10    so  announce and publish the fact, and such decision shall be
11    final and the set of  electors  so  determined  upon  by  the
12    electoral  board  to be so chosen shall be the list or set of
13    electors  to  be  deemed  elected  if  that  party  shall  be
14    successful at the polls, as herein provided.
15        (e)  Should a vacancy occur in the choice of  an  elector
16    in  a  congressional  district, such vacancy may be filled by
17    the executive committee  of  the  party  or  group  for  such
18    congressional  district, to be certified by such committee to
19    the State Board of Elections. Should a vacancy occur  in  the
20    office  of  elector at large, such vacancy shall be filled by
21    the State committee of such political  party  or  group,  and
22    certified by it to the State Board of Elections.
23        (f)  Presidential  and  vice-presidential  electors  must
24    cast  their  votes  for  the  winner of the statewide popular
25    vote.
