 1        AN ACT relating to genetic testing information.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Genetic  Information  Privacy  Act  is
 5    amended by changing Section 20 as follows:

 6        (410 ILCS 513/20)
 7        Sec.   20.  Use   of   genetic  testing  information  for
 8    insurance purposes.
 9        (a)  An insurer may not  seek  information  derived  from
10    genetic  testing  for  use  in connection with an a policy of
11    accident and health insurance policy.  Except as provided  in
12    subsection  (b), an insurer that receives information derived
13    from genetic testing  may  not  use  the  information  for  a
14    nontherapeutic  purpose as it relates to a policy of accident
15    and health insurance.
16        (b)  An insurer  may  consider  the  results  of  genetic
17    testing  in  connection  with a policy of accident and health
18    insurance if the individual voluntarily submits  the  results
19    and the results are favorable to the individual.
20        (c)  An  insurer  that possesses information derived from
21    genetic testing may not release the information  to  a  third
22    party, except as specified in Section 30.
