92_SB0045 LRB9201500JSpc 1 AN ACT concerning crime victim compensation. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Crime Victims Compensation Act is amended 5 by changing Section 6.1 as follows: 6 (740 ILCS 45/6.1) (from Ch. 70, par. 76.1) 7 Sec. 6.1. Right to compensation. A person is entitled to 8 compensation under this Act if: 9 (a) Within one year of the occurrence of the crime upon 10 which the claim is based, he files an application, under 11 oath, with the Court of Claims and on a form prescribed in 12 accordance with Section 7.1 furnished by the Attorney 13 General. If the person entitled to compensation is under 18 14 years of age or under other legal disability at the time of 15 the occurrence or becomes legally disabled as a result of the 16 occurrence, he may file the application required by this 17 subsection within one year after he attains the age of 18 18 years or the disability is removed, as the case may be. Upon 19 good cause shown, the Court of Claims may extend the time for 20 filing the application for a period not exceeding one year. 21 The Court of Claims may by general orders provide for the 22 extensions of time to file applications. 23 (b) The appropriate law enforcement officials were 24 notified within 72 hours of the perpetration of the crime 25 allegedly causing the death or injury to the victim or, in 26 the event such notification was made more than 72 hours after 27 the perpetration of the crime, the applicant establishes that 28 such notice was timely under the circumstances. 29 (c) The applicant has cooperated fully with law 30 enforcement officials in the apprehension and prosecution of 31 the assailant. -2- LRB9201500JSpc 1 (d) The applicant is not the offender or an accomplice 2 of the offender and the award would not unjustly benefit the 3 offender or his accomplice. 4 (e) The injury to or death of the victim was not 5 substantially attributable to his own wrongful act and was 6 not substantially provoked by the victim. 7 (Source: P.A. 86-1009; 86-1221.)
