92_SB0462 LRB9207722ACcd 1 AN ACT concerning education. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The School Construction Law is amended by 5 changing Section 5-100 as follows: 6 (105 ILCS 230/5-100) 7 Sec. 5-100. School maintenance project grants. 8 (a) The State Board of Education is authorized to make 9 grants to school districts or State-designated area 10 vocational centers, without regard to enrollment, for school 11 maintenance projects. These grants shall be paid out of 12 moneys appropriated for that purpose from the School 13 Infrastructure Fund. No grant under this Section for one 14 fiscal year shall exceed $50,000, but a school district may 15 receive grants for more than one project during one fiscal 16 year. A school district or State-designated area vocational 17 center must provide local matching funds in an amount equal 18 to the amount of the grant under this Section. A school 19 district has no entitlement to a grant under this Section. 20 (b) The State Board of Education shall adopt rules to 21 implement this Section. These rules need not be the same as 22 the rules for school construction project grants or debt 23 service grants. 24 The rules may specify: (1) the manner of applying for 25 grants; (2) project eligibility requirements; (3) 26 restrictions on the use of grant moneys; (4) the manner in 27 which school districts or State-designated area vocational 28 centers must account for the use of grant moneys; and (5) any 29 other provision that the State Board determines to be 30 necessary or useful for the administration of this Section. 31 The rules shall specify the methods and standards to be -2- LRB9207722ACcd 1 used by the State Board to prioritize applications. School 2 maintenance projects shall be prioritized in the following 3 order: 4 (i) emergency projects; 5 (ii) health/life safety projects; 6 (iii) State Program priority projects; 7 (iv) permanent improvement projects; and 8 (v) other projects. 9 (c) In each school year in which school maintenance 10 project grants are awarded, 20% of the total amount awarded 11 shall be awarded to a school district with a population of 12 more than 500,000, provided that the school district complies 13 with the requirements of this Section and the rules adopted 14 under this Section. 15 (Source: P.A. 91-38, eff. 6-15-99.)
