 1        AN ACT in relation to senior citizens.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  1.   Short  title.  This Act may be cited as the
 5    Statewide Senior Citizen Victimizer Database Act.

 6        Section 5.  Definitions. In this Act:
 7        "Department" means Department of State Police.
 8        "Director" means the Director of State Police.
 9        "Senior citizen" means a person of the age of 60 years or
10    older.
11        "Senior citizen victimizer" means a person who  has  been
12    arrested for committing an offense against a senior citizen.
13        "Statewide  Senior  Citizen Victimizer Database Terminal"
14    means   an   interactive   computerized   communication   and
15    processing unit that  permits  direct  on-line  communication
16    with  the  Department  of  State  Police's  Statewide  Senior
17    Citizen Victimizer Database.

18        Section  10.   Duties  of the Department.  The Department
19    may:
20        (a) Provide a uniform reporting format for the  entry  of
21    pertinent  information  regarding  the  report of an arrested
22    senior citizen victimizer into the Senior Citizen  Victimizer
23    Database Terminal;
24        (b)  Notify  all law enforcement agencies that reports of
25    arrested senior citizen victimizers shall be entered into the
26    database as soon as the minimum level of data of  information
27    specified  by  the  Department  is available to the reporting
28    agency, and that no waiting period for the entry of that data
29    exists;
30        (c)  Compile and maintain a data repository  relating  to

 1    senior  citizen  victimizers  in  order to gather information
 2    regarding the various modus operandi used to victimize senior
 3    citizens,  groups  that  tend  to  routinely  target   senior
 4    citizens,  areas of the State that senior citizen victimizers
 5    tend to frequent, and the  type  of  persons  senior  citizen
 6    victimizers routinely target;
 7        (d)   Develop   and   improve   techniques  used  by  law
 8    enforcement agencies and prosecutors  in  the  investigation,
 9    apprehension, and prosecution of senior citizen victimizers;
10        (e)  Locate  all  law enforcement agencies that could, in
11    the opinion of the  Director,  benefit  from  access  to  the
12    Statewide Senior Citizen Victimizer Database, and notify them
13    of its existence; and
14        (f)  Cooperate  with all law enforcement agencies wishing
15    to gain access to the  Statewide  Senior  Citizen  Victimizer
16    Database  system,  and  to  facilitate  their  entry into the
17    system and to their continued maintenance of access to it.

18        Section 15.  Duties of local  law  enforcement  agencies.
19    Local  law  enforcement  agencies  that  are  members  of the
20    Statewide Senior Citizen Victimizer Database system may:
21        (a)  After arresting any person whom they believe to be a
22    senior citizen victimizer, create  or  update  that  person's
23    electronic   file   within   the   Statewide  Senior  Citizen
24    Victimizer Database system; and
25        (b) Notify the prosecutor of an accused of  that  accused
26    person's   history  of  perpetrating  crimes  against  senior
27    citizens.
