 1        AN ACT in relation to property.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Code of Civil  Procedure  is  amended  by
 5    changing Section 7-103 as follows:

 6        (735 ILCS 5/7-103) (from Ch. 110, par. 7-103)
 7        Sec. 7-103.  "Quick-take".
 8        (a)  This  Section applies only to proceedings under this
 9    Article that are authorized in the  Sections  following  this
10    Section and preceding Section 7-104.
11        (a-5)  On and after the effective date of this amendatory
12    Act  of the 92nd General Assembly, a unit of local government
13    that acquires  property  in  a  proceeding  subject  to  this
14    Section  may  not  thereafter transfer the property, by sale,
15    lease, or otherwise, to a private individual or entity.
16        (a-10)  A  unit  of   local   government   may   exercise
17    "quick-take"  powers  to acquire real property or an interest
18    in real property under this Article only with respect to real
19    property  lying  within  the  limits   of   its   territorial
20    jurisdiction.  Before  the  General Assembly may consider any
21    amendment of this Section that adds an  authorization  for  a
22    unit  of  local  government  to  acquire  real property or an
23    interest in real property under  this  Section,  all  of  the
24    following must occur:
25             (1)  The   governing  body  of  the  unit  of  local
26        government shall hold at least one public hearing on  the
27        matter  of  the proposed acquisition.  The governing body
28        must give notice of  the  hearing  by  publication  in  a
29        newspaper   published   in   the   territory   under  the
30        jurisdiction of the unit of local government  or,  if  no
31        newspaper  is published in that territory, in a newspaper

 1        of general circulation in that territory.  At the hearing
 2        the governing body shall give members of  the  public  an
 3        opportunity to ask questions and offer comments orally or
 4        in writing or both.
 5             (2)  After  the  conclusion  of  the  public hearing
 6        process required under paragraph (1), and not on the same
 7        day as a hearing  conducted  under  that  paragraph,  the
 8        governing  body  of  the  unit  of local government shall
 9        adopt  by  recorded  vote  a  resolution  requesting   an
10        authorization  to exercise "quick-take" powers to acquire
11        the property or interest in property under this Article.
12             (3)  After adopting  a  resolution  under  paragraph
13        (2),  the  governing body of the unit of local government
14        shall file with the Secretary of the Senate and the Clerk
15        of the House of Representatives all of the following:
16                  (A)  A copy of the resolution.
17                  (B)  The legal description of the  property  or
18             interest  in  property  sought to be acquired by the
19             exercise of "quick-take" powers under this Article.
20                  (C)  An appraisal of the fair market  value  of
21             the  property  or  interest in property sought to be
22             acquired by  the  unit  of  local  government.   The
23             appraisal   must   be  prepared  by  an  independent
24             qualified real estate appraiser.
25                  (D)  An explanation of the public purposes that
26             the unit of local government intends to  further  by
27             the  acquisition  of  the  property  or  interest in
28             property.
29        This subsection (a-10) applies only to authorizations  to
30    acquire  real  property or an interest in real property under
31    this Section that take effect after  the  effective  date  of
32    this amendatory Act of the 92nd General Assembly.

29        (b)  In  a  proceeding  subject  to  this  Section,   the
30    plaintiff, at any time after the complaint has been filed and
31    before  judgment  is  entered  in  the proceeding, may file a
32    written  motion  requesting  that,  immediately  or  at  some
33    specified later date, the plaintiff either be vested with the
34    fee  simple  title  (or  such  lesser  estate,  interest   or

 1    easement,  as  may  be  required)  to  the  real property, or
 2    specified portion  thereof,  which  is  the  subject  of  the
 3    proceeding,  and  be authorized to take possession of and use

 6    the  vesting of title, are sufficient to permit the plaintiff
 7    to proceed with the project until the final ascertainment  of
 8    compensation;  however,  no  land or interests therein now or
 9    hereafter owned, leased, controlled or operated and used  by,
10    or  necessary for the actual operation of, any common carrier
11    engaged in interstate commerce, or any other  public  utility
12    subject   to   the  jurisdiction  of  the  Illinois  Commerce
13    Commission, shall be taken or appropriated hereunder  by  the
14    State  of  Illinois, the Illinois Toll Highway Authority, the
15    sanitary district, the St. Louis  Metropolitan  Area  Airport
16    Authority  or  the  Board  of  Trustees  of the University of
17    Illinois  without  first  securing  the  approval   of   such
18    Commission.
19        Except as hereinafter stated, the motion for taking shall
20    state:  (1)  an accurate description of the property to which
21    the motion relates and the estate or interest  sought  to  be
22    acquired  therein;  (2) the formally adopted schedule or plan
23    of operation for the execution of  the  plaintiff's  project;
24    (3)  the  situation  of  the  property  to  which  the motion
25    relates, with respect  to  the  schedule  or  plan;  (4)  the
26    necessity for taking such property in the manner requested in
27    the   motion;  and  (5)  if  the  property  (except  property
28    described in Section 3 of the Sports Stadium Act, or property
29    described as Site B in Section 2 of the Metropolitan Pier and
30    Exposition Authority Act)  to  be  taken  is  owned,  leased,
31    controlled  or  operated  and  used  by, or necessary for the
32    actual operation of, any interstate common carrier  or  other
33    public  utility  subject  to the jurisdiction of the Illinois
34    Commerce Commission, a  statement  to  the  effect  that  the

 1    approval  of  such proposed taking has been secured from such
 2    Commission, and attaching to such motion a certified copy  of
 3    the  order of such Commission granting such approval.  If the
 4    schedule or plan of operation is not set forth fully  in  the

 6    the motion.
