92_SB0643ham001 LRB9207934JMmbam01 1 AMENDMENT TO SENATE BILL 643 2 AMENDMENT NO. . Amend Senate Bill 643 by replacing 3 everything after the enacting clause with the following: 4 "Section 5. The Criminal Identification Act is amended 5 by changing Section 3.1 as follows: 6 (20 ILCS 2630/3.1) (from Ch. 38, par. 206-3.1) 7 Sec. 3.1. Conviction records. 8 (a) The Department may furnish, pursuant to positive 9 identification, records of convictions to the Department of 10 Professional Regulation for the purpose of meeting 11 registration or licensure requirements under The Private 12 Detective, Private Alarm, and Private Security Act of 1983. 13 (b) The Department may furnish, pursuant to positive 14 identification, records of convictions to policing bodies of 15 this State for the purpose of assisting local liquor control 16 commissioners in carrying out their duty to refuse to issue 17 licenses to persons specified in paragraphs (4), (5) and (6) 18 of Section 6-2 of The Liquor Control Act of 1934. 19 (c) The Department shall charge an application fee, 20 based on actual costs, for the dissemination of records 21 pursuant to this Section. Fees received for the 22 dissemination of records pursuant to this Section shall be -2- LRB9207934JMmbam01 1 deposited in the State Police Services Fund. The Department 2 is empowered to establish this fee and to prescribe the form 3 and manner for requesting and furnishing conviction 4 information pursuant to this Section. 5 (d) Any dissemination of any information obtained 6 pursuant to this Section to any person not specifically 7 authorized hereby to receive or use it for the purpose for 8 which it was disseminated shall constitute a violation of 9 Section 7. 10 (Source: P.A. 85-1440.)".
