92_SB0707 LRB9207688EGfgA 1 AN ACT in relation to public employee benefits. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Pension Code is amended by 5 changing Section 5-214 as follows: 6 (40 ILCS 5/5-214) (from Ch. 108 1/2, par. 5-214) 7 Sec. 5-214. Credit for other service. Any participant 8 in this Fund (other than a member of the fire department of 9 the city) who has rendered service as a member of the police 10 department of the city for a period of 3 years or more (15 11 years or more in the case of paragraph (e) of this Section) 12 is entitled to credit for the various purposes of this 13 Article for service rendered prior to becoming a member or 14 subsequent thereto for the following periods: 15 (a) While on leave of absence from the police 16 department assigned or detailed to investigative, 17 protective, security or police work for the park district 18 of the city, the department of the Port of Chicago or the 19 sanitary district in which the city is located. 20 (b) As a temporary police officer in the city or 21 while serving in the office of the mayor or in the office 22 of the corporation counsel, as a member of the city 23 council of the city, as an employee of the Policemen's 24 Annuity and Benefit Fund created by this Article, as the 25 head of an organization whose membership consists of 26 members of the police department, the Public Vehicle 27 License Commission and the board of election 28 commissioners of the city. 29 (c) While performing safety or investigative work 30 for the county in which such city is principally located 31 or for the State of Illinois or for the federal -2- LRB9207688EGfgA 1 government, on leave of absence from the department of 2 police, or while performing investigative work for the 3 department as a civilian employee of the department. 4 (d) While on leave of absence from the police 5 department of the city and serving as the chief of police 6 of a police department outside the city. 7 (e) Up to 7 years during which the applicant 8 performed corrections work for the county in which the 9 city is principally located or for the State of Illinois 10 or for the federal government. 11 No credit shall be granted in this Fund, however, for 12 this service if the policeman has credit therefor in any 13 other annuity and benefit fund, or unless he contributes to 14 this Fund the amount he would have contributed with interest 15 had he remained an active member of the police department in 16 the position he occupied as a result of a civil service 17 competitive examination, certification and appointment by the 18 Civil Service Board; or in the case of a city operating under 19 the provisions of a personnel ordinance the position he 20 occupied as a result of a personnel ordinance competitive 21 examination certification and appointment under the authority 22 of a Municipal Personnel ordinance. 23 Concurrently with such contributions, the city shall 24 contribute the amounts provided by this Article. No credit 25 shall be allowed for any period of time for which 26 contributions by the policeman have not been paid. The 27 period of service rendered by such policeman prior to the 28 date he became a member of the police department of the city 29 or while detailed, assigned or on leave of absence and 30 employed in any of the departments set forth hereinabove in 31 this Section for which such policeman has contributed to this 32 Fund shall be credited to him as service for all the purposes 33 of this Article, except that he shall not have any of the 34 rights conferred by the provisions of Sections 5-127 and -3- LRB9207688EGfgA 1 5-162 of this Article. 2 The changes in this Section made by Public Act 86-273 3 shall apply to members of the Fund who have not begun 4 receiving a pension under this Article on August 23, 1989, 5 without regard to whether employment is terminated before 6 that date. 7 (Source: P.A. 86-273; 87-1265.) 8 Section 90. The State Mandates Act is amended by adding 9 Section 8.25 as follows: 10 (30 ILCS 805/8.25 new) 11 Sec. 8.25. Exempt mandate. Notwithstanding Sections 6 12 and 8 of this Act, no reimbursement by the State is required 13 for the implementation of any mandate created by this 14 amendatory Act of the 92nd General Assembly. 15 Section 99. Effective date. This Act takes effect upon 16 becoming law.
