1 AMENDMENT TO SENATE BILL 868
2 AMENDMENT NO. . Amend Senate Bill 868 on page 7,
3 line 15, by inserting "or refusal" after "failure"; and
4 on page 7, line 32, by replacing "the employer" with the
5 following:
6 "each such named corporate officer, director, partner, or
7 member"; and
8 on page 7, by replacing lines 33 and 34 with the following:
9 "comply with this Section. The liability for the assessed
10 penalty shall be against the named employer first, and if the
11 named employer fails or refuses to pay the penalty to the
12 Commission within 30 days after the final order of the
13 Commission, then the named corporate officers, directors,
14 partners, or members who have been found to have knowingly
15 and willfully refused or failed to comply with this Section
16 shall be liable for the unpaid penalty or any unpaid portion
17 of the penalty. All".
