92_SB0900enr SB900 Enrolled LRB9206799NTsbA 1 AN ACT in relation to real property. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Board of Trustees of Southern Illinois 5 University is authorized to sell or exchange for other real 6 property of substantially equal value, before January 1, 7 2003, certain real property located in Sangamon County, 8 Illinois and described as follows: 9 Part of the Southwest quarter of the Northwest quarter of 10 Section Ten (10), Township Thirteen (13) North, Range Six 11 (6), West of the Third Principal Meridian, Described as 12 follows: Beginning at a point on the North Right-of-Way 13 line of S.B.I. Route 104, said point being 102 feet 14 westerly from the Southwest corner of Lot Thirteen (13) 15 of Western Acres, Plat One, thence North 177.58 feet to 16 the Southeast corner of Lot Seventeen (17) in said 17 Western Acres, Plat One; thence deflecting Left 90 18 Degrees, 27 Minutes measure 38.0 feet (38.5 feet 19 recorded) to the Southwest Corner of said Lot Seventeen 20 (17); thence deflecting Right 7 Degrees, 05 Minutes 21 measure 200 feet; thence deflecting Left 106 Degrees 46 22 Minutes measure 269.92 feet to a point on the North 23 Right-of-Way line of S.B.I. Route 104; thence easterly 24 along said North Right-of-Way line, measure a chord 25 distance of 200 feet to the point of beginning. 26 Section 10. The sale or exchange of the real property 27 described in Section 5 of this Act shall be made in full 28 compliance with the State Property Control Act, provided that 29 the net proceeds received by the Board of Trustees of 30 Southern Illinois University from the sale or exchange of the 31 real property described in Section 5 of this Act shall be SB900 Enrolled -2- LRB9206799NTsbA 1 deposited by the Board of Trustees of Southern Illinois 2 University into the Repair and Replacement Reserve Account of 3 the Southern Illinois University Medical Facilities System 4 created by the resolution of the Board of Trustees of 5 Southern Illinois University that was adopted on October 10, 6 1996, pursuant to the Southern Illinois University Revenue 7 Bond Act. 8 Section 90. The State Property Control Act is amended by 9 changing Section 1.02 as follows: 10 (30 ILCS 605/1.02) (from Ch. 127, par. 133b3) 11 Sec. 1.02. "Property" means State owned property and 12 includes all real estate, with the exception of rights of way 13 for State water resource and highway improvements, traffic 14 signs and traffic signals, and with the exception of common 15 school property; and all tangible personal property with the 16 exception of properties specifically exempted by the 17 administrator, provided that any property originally 18 classified as real property which has been detached from its 19 structure shall be classified as personal property. 20 "Property" does not include property owned by the 21 Illinois Medical District Commission and leased or occupied 22 by others for purposes permitted under the Illinois Medical 23 District Act. "Property" also does not include property 24 owned and held by the Illinois Medical District Commission 25 for redevelopment. 26 "Property" does not include that property described under 27 Section 5 of this amendatory Act of the 92nd General Assembly 28 with respect to depositing the net proceeds from the sale or 29 exchange of the property as provided in Section 10 of this 30 amendatory Act of the 92nd General Assembly. 31 (Source: P.A. 89-356, eff. 8-17-95.)
