92_SB1009 SRS92SB0032SFap 1 AN ACT in relation to vehicles. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Illinois Vehicle Code is amended by 5 adding Section 11-212 as follows: 6 (625 ILCS 5/11-212 new) 7 Sec. 11-212. Roadside safety stops without probable 8 cause prohibited. 9 (a) A police officer may not conduct a roadside safety 10 check of a motor vehicle without probable cause that the 11 driver of the vehicle has violated a provision of this Code 12 or a similar provision of a local ordinance. Any evidence 13 obtained against the driver who was stopped in violation of 14 this Section is inadmissible in any prosecution of a 15 violation of this Code or of a similar violation of a local 16 ordinance. 17 (b) In this Section, "roadside safety check" means the 18 stopping of each motor vehicle by a police officer at a 19 particular location without probable cause for the purpose of 20 determining whether the driver of the vehicle has committed a 21 violation of this Code or a similar provision of a local 22 ordinance.
