92_SB1032 LRB9207626ARsbC 1 AN ACT concerning labor relations. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Unified Code of Corrections is amended by 5 adding Section 3-7- 2.5 as follows: 6 (730 ILCS 5/3-7-2.5 new) 7 Sec. 3-7-2.5. Zero tolerance drug policy. 8 (a) Any person employed by the Department of Corrections 9 who tests positive for any substance prohibited by the 10 Cannabis Control Act or the Illinois Controlled Substances 11 Act shall be discharged from employment. Testing shall be 12 conducted in accordance with procedures for drug testing 13 established by the Department including, but not limited to, 14 random, reasonable suspicion, and vehicular post-accident 15 drug testing. Failure to submit to a drug test by any person 16 employed by the Department shall be construed as a positive 17 test, and the person shall be discharged from employment. 18 (b) Any person employed by the Department who is 19 discharged in accordance with the provisions of subsection 20 (a) shall not be eligible for rehire. 21 Section 99. This Act takes effect upon becoming law.
