92_SB1039ham002 LRB9205338JMmbam03 1 AMENDMENT TO SENATE BILL 1039 2 AMENDMENT NO. . Amend Senate Bill 1039 on page 2, by 3 replacing lines 13 through 18 with the following: 4 "is delinquent in the payment of a debt to the State in an 5 amount exceeding $1,000 and that is more than 90 days past 6 due. A person is not delinquent in the payment of a debt 7 under this Section if the person: 8 (1) has entered into and is complying with the 9 terms of a deferred payment plan or other settlement 10 agreement with the State agency to resolve the debt; or 11 (2) is contesting the debt in an administrative or 12 judicial forum and a final judgment has not been 13 rendered. 14 The Debt Collection Board shall adopt rules further defining 15 the phrase "delinquent in the payment of a debt" for purposes 16 of this Section."; and 17 on page 3, by replacing lines 10 and 11 with the following: 18 "of the State. The chief procurement officer shall adopt 19 rules establishing the factors that may be considered when 20 determining whether to void a contract under this subsection 21 (b).".
