92_SB1109enr SB1109 Enrolled SRS92SB0033PMcp 1 AN ACT concerning the circulation of election petitions. 2 Be it enacted by the People of the State of Illinois, 3 represented in the General Assembly: 4 Section 5. The Election Code is amended by changing 5 Sections 3-1.2, 7-10, 8-8, 10-4, and 28-3 as follows: 6 (10 ILCS 5/3-1.2) (from Ch. 46, par. 3-1.2) 7 Sec. 3-1.2. Eligibility to signor circulatepetition. 8 For the purpose of determining eligibility to signor9circulatea nominating petition or a petition proposing a 10 public question the terms "voter", "registered voter", 11 "qualified voter", "legal voter", "elector", "qualified 12 elector", "primary elector" and "qualified primary elector" 13 as used in this Code or in another Statute shall mean a 14 person who is registered to vote at the address shown 15 opposite his signature on the petition or was registered to 16 vote at such address when he signed the petition. Any person, 17 otherwise qualified under this Section, who has not moved to 18 another residence but whose address has changed as a result 19 of implementation of a 9-1-1 emergency telephone system shall 20 be considered a "voter", "registered voter", "qualified 21 voter", "legal voter", "elector", "qualified elector", 22 "primary elector", and "qualified primary elector". 23 (Source: P.A. 90-664, eff. 7-30-98; 91-57, eff. 6-30-99.) 24 (10 ILCS 5/7-10) (from Ch. 46, par. 7-10) 25 Sec. 7-10. Form of petition for nomination. The name of 26 no candidate for nomination, or State central committeeman, 27 or township committeeman, or precinct committeeman, or ward 28 committeeman or candidate for delegate or alternate delegate 29 to national nominating conventions, shall be printed upon the 30 primary ballot unless a petition for nomination has been SB1109 Enrolled -2- SRS92SB0033PMcp 1 filed in his behalf as provided in this Article in 2 substantially the following form: 3 We, the undersigned, members of and affiliated with the 4 .... party and qualified primary electors of the .... party, 5 in the .... of ...., in the county of .... and State of 6 Illinois, do hereby petition that the following named person 7 or persons shall be a candidate or candidates of the .... 8 party for the nomination for (or in case of committeemen for 9 election to) the office or offices hereinafter specified, to 10 be voted for at the primary election to be held on (insert 11 date). 12 Name Office Address 13 John Jones Governor Belvidere, Ill. 14 Thomas Smith Attorney General Oakland, Ill. 15 Name.................. Address....................... 16 State of Illinois) 17 ) ss. 18 County of........) 19 I, ...., do hereby certifythat I am a registered voter20and have been a registered voter at all times I have21circulated this petition,that I reside at No. .... street, 22 in the .... of ...., county of ...., and State of ....., that 23 I am 18 years of age or olderIllinois, that I am a citizen 24 of the United States, and that the signatures on this sheet 25 were signed in my presence, and are genuine, and that to the 26 best of my knowledge and belief the persons so signing were 27 at the time of signing the petitions qualified voters of the 28 .... party, and that their respective residences are 29 correctly stated, as above set forth. 30 ......................... 31 Subscribed and sworn to before me on (insert date). 32 ......................... 33 Each sheet of the petition other than the statement of 34 candidacy and candidate's statement shall be of uniform size SB1109 Enrolled -3- SRS92SB0033PMcp 1 and shall contain above the space for signatures an 2 appropriate heading giving the information as to name of 3 candidate or candidates, in whose behalf such petition is 4 signed; the office, the political party represented and place 5 of residence; and the heading of each sheet shall be the 6 same. 7 Such petition shall be signed by qualified primary 8 electors residing in the political division for which the 9 nomination is sought in their own proper persons only and 10 opposite the signature of each signer, his residence address 11 shall be written or printed. The residence address required 12 to be written or printed opposite each qualified primary 13 elector's name shall include the street address or rural 14 route number of the signer, as the case may be, as well as 15 the signer's county, and city, village or town, and state. 16 However the county or city, village or town, and state of 17 residence of the electors may be printed on the petition 18 forms where all of the electors signing the petition reside 19 in the same county or city, village or town, and state. 20 Standard abbreviations may be used in writing the residence 21 address, including street number, if any. At the bottom of 22 each sheet of such petition shall be added a circulator 23 statement signed by a person 18 years of age or older who is 24 a citizen of the United Statesregistered voter of the25political division, who has been a registered voter at all26times he or she circulated the petition, for which the27candidate is seeking a nomination, stating the street address 28 or rural route numberof the voter, as the case may be, as 29 well as thevoter'scounty,andcity, village or town, and 30 state; and certifying that the signatures on that sheet of 31 the petition were signed in his or her presence and 32 certifying that the signatures are genuine; and either (1) 33 indicating the dates on which that sheet was circulated, or 34 (2) indicating the first and last dates on which the sheet SB1109 Enrolled -4- SRS92SB0033PMcp 1 was circulated, or (3) certifying that none of the signatures 2 on the sheet were signed more than 90 days preceding the last 3 day for the filing of the petition, or more than 45 days4preceding the last day for filing of the petition in the case5of political party and independent candidates for single or6multi-county regional superintendents of schools in the 19947general primary election; and certifying that the signatures8on the sheet are genuine,and certifying that to the best of 9 his or her knowledge and belief the persons so signing were 10 at the time of signing the petitions qualified voters of the 11 political party for which a nomination is sought. Such 12 statement shall be sworn to before some officer authorized to 13 administer oaths in this State. 14 No petition sheet shall be circulated more than 90 days 15 preceding the last day provided in Section 7-12 for the 16 filing of such petition, or more than 45 days preceding the17last day for filing of the petition in the case of political18party and independent candidates for single or multi-county19regional superintendents of schools in the 1994 general20primary election. 21 The person circulating the petition, or the candidate on 22 whose behalf the petition is circulated, may strike any 23 signature from the petition, provided that:;24 (1) the person striking the signature shall initial 25 the petition at the place where the signature is struck; 26 and 27 (2) the person striking the signature shall sign a 28 certification listing the page number and line number of 29 each signature struck from the petition. Such 30 certification shall be filed as a part of the petition. 31 Such sheets before being filed shall be neatly fastened 32 together in book form, by placing the sheets in a pile and 33 fastening them together at one edge in a secure and suitable 34 manner, and the sheets shall then be numbered consecutively. SB1109 Enrolled -5- SRS92SB0033PMcp 1 The sheets shall not be fastened by pasting them together end 2 to end, so as to form a continuous strip or roll. All 3 petition sheets which are filed with the proper local 4 election officials, election authorities or the State Board 5 of Elections shall be the original sheets which have been 6 signed by the voters and by the circulator thereof, and not 7 photocopies or duplicates of such sheets. Each petition must 8 include as a part thereof, a statement of candidacy for each 9 of the candidates filing, or in whose behalf the petition is 10 filed. This statement shall set out the address of such 11 candidate, the office for which he is a candidate, shall 12 state that the candidate is a qualified primary voter of the 13 party to which the petition relates and is qualified for the 14 office specified (in the case of a candidate for State's 15 Attorney it shall state that the candidate is at the time of 16 filing such statement a licensed attorney-at-law of this 17 State), shall state that he has filed (or will file before 18 the close of the petition filing period) a statement of 19 economic interests as required by the Illinois Governmental 20 Ethics Act, shall request that the candidate's name be placed 21 upon the official ballot, and shall be subscribed and sworn 22 to by such candidate before some officer authorized to take 23 acknowledgment of deeds in the State and shall be in 24 substantially the following form: 25 Statement of Candidacy 26 Name Address Office District Party 27 John Jones 102 Main St. Governor Statewide Republican 28 Belvidere, 29 Illinois 30 State of Illinois) 31 ) ss. 32 County of .......) 33 I, ...., being first duly sworn, say that I reside at 34 .... Street in the city (or village) of ...., in the county SB1109 Enrolled -6- SRS92SB0033PMcp 1 of ...., State of Illinois; that I am a qualified voter 2 therein and am a qualified primary voter of the .... party; 3 that I am a candidate for nomination (for election in the 4 case of committeeman and delegates and alternate delegates) 5 to the office of .... to be voted upon at the primary 6 election to be held on (insert date); that I am legally 7 qualified (including being the holder of any license that may 8 be an eligibility requirement for the office I seek the 9 nomination for) to hold such office and that I have filed (or 10 I will file before the close of the petition filing period) a 11 statement of economic interests as required by the Illinois 12 Governmental Ethics Act and I hereby request that my name be 13 printed upon the official primary ballot for nomination for 14 (or election to in the case of committeemen and delegates and 15 alternate delegates) such office. 16 Signed ...................... 17 Subscribed and sworn to (or affirmed) before me by ...., 18 who is to me personally known, on (insert date). 19 Signed .................... 20 (Official Character) 21 (Seal, if officer has one.) 22 The petitions, when filed, shall not be withdrawn or 23 added to, and no signatures shall be revoked except by 24 revocation filed in writing with the State Board of 25 Elections, election authority or local election official with 26 whom the petition is required to be filed, and before the 27 filing of such petition. Whoever forges the name of a signer 28 upon any petition required by this Article is deemed guilty 29 of a forgery and on conviction thereof shall be punished 30 accordingly. 31 Petitions of candidates for nomination for offices herein 32 specified, to be filed with the same officer, may contain the 33 names of 2 or more candidates of the same political party for 34 the same or different offices. SB1109 Enrolled -7- SRS92SB0033PMcp 1 Such petitions for nominations shall be signed: 2 (a) If for a State office, or for delegate or 3 alternate delegate to be elected from the State at large 4 to a National nominating convention by not less than 5 5,000 nor more than 10,000 primary electors of his party. 6 (b) If for a congressional officer or for delegate 7 or alternate delegate to be elected from a congressional 8 district to a national nominating convention by at least 9 .5% of the qualified primary electors of his party in his 10 congressional district, except that for the first primary 11 following a redistricting of congressional districts such 12 petitions shall be signed by at least 600 qualified 13 primary electors of the candidate's party in his 14 congressional district. 15 (c) If for a county office (including county board 16 member and chairman of the county board where elected 17 from the county at large), by at least .5% of the 18 qualified electors of his party cast at the last 19 preceding general election in his county. However, if 20 for the nomination for county commissioner of Cook 21 County, then by at least .5% of the qualified primary 22 electors of his or her party in his or her county in the 23 district or division in which such person is a candidate 24 for nomination; and if for county board member from a 25 county board district, then by at least .5% of the 26 qualified primary electors of his party in the county 27 board district. In the case of an election for county 28 board member to be elected from a district, for the first 29 primary following a redistricting of county board 30 districts or the initial establishment of county board 31 districts, then by at least .5% of the qualified electors 32 of his party in the entire county at the last preceding 33 general election, divided by the number of county board 34 districts, but in any event not less than 25 qualified SB1109 Enrolled -8- SRS92SB0033PMcp 1 primary electors of his party in the district. 2 (d) If for a municipal or township office by at 3 least .5% of the qualified primary electors of his party 4 in the municipality or township; if for alderman, by at 5 least .5% of the voters of his party of his ward. In the 6 case of an election for alderman or trustee of a 7 municipality to be elected from a ward or district, for 8 the first primary following a redistricting or the 9 initial establishment of wards or districts, then by .5% 10 of the total number of votes cast for the candidate of 11 such political party who received the highest number of 12 votes in the entire municipality at the last regular 13 election at which an officer was regularly scheduled to 14 be elected from the entire municipality, divided by the 15 number of wards or districts, but in any event not less 16 than 25 qualified primary electors of his party in the 17 ward or district. 18 (e) If for State central committeeman, by at least 19 100 of the primary electors of his or her party of his or 20 her congressional district. 21 (f) If for a candidate for trustee of a sanitary 22 district in which trustees are not elected from wards, by 23 at least .5% of the primary electors of his party, from 24 such sanitary district. 25 (g) If for a candidate for trustee of a sanitary 26 district in which the trustees are elected from wards, by 27 at least .5% of the primary electors of his party in his 28 ward of such sanitary district, except that for the first 29 primary following a reapportionment of the district such 30 petitions shall be signed by at least 150 qualified 31 primary electors of the candidate's ward of such sanitary 32 district. 33 (h) IfThe number of signatures requiredfor a 34 candidate for judicial office in a district, circuit, or SB1109 Enrolled -9- SRS92SB0033PMcp 1 subcircuit, by a number of primary electors at least 2 equal toshall be0.25% of the number of votes cast for 3 the judicial candidate of his or her political party who 4 received the highest number of votes at the last regular 5 general election at which a judicial officer from the 6 same district, circuit, or subcircuit was regularly 7 scheduled to be elected, but in no event fewershall be8lessthan 500signatures. 9 (i) If for a candidate for precinct committeeman, 10 by at least 10 primary electors of his or her party of 11 his or her precinct; if for a candidate for ward 12 committeeman, by not less than 10% nor more than 16% (or 13 50 more than the minimum, whichever is greater) of the 14 primary electors of his party of his ward; if for a 15 candidate for township committeeman, by not less than 5% 16 nor more than 8% (or 50 more than the minimum, whichever 17 is greater) of the primary electors of his party in his 18 township or part of a township as the case may be. 19 (j) If for a candidate for State's Attorney or 20 Regional Superintendent of Schools to serve 2 or more 21 counties, by at least .5% of the primary electors of his 22 party in the territory comprising such counties. 23 (k) If for any other office by at least .5% of the 24 total number of registered voters of the political 25 subdivision, district or division for which the 26 nomination is made or a minimum of 25, whichever is 27 greater. 28 For the purposes of this Section the number of primary 29 electors shall be determined by taking the total vote cast, 30 in the applicable district, for the candidate for such 31 political party who received the highest number of votes, 32 state-wide, at the last general election in the State at 33 which electors for President of the United States were 34 elected. For political subdivisions, the number of primary SB1109 Enrolled -10- SRS92SB0033PMcp 1 electors shall be determined by taking the total vote cast 2 for the candidate for such political party who received the 3 highest number of votes in such political subdivision at the 4 last regular election at which an officer was regularly 5 scheduled to be elected from that subdivision. For wards or 6 districts of political subdivisions, the number of primary 7 electors shall be determined by taking the total vote cast 8 for the candidate for such political party who received the 9 highest number of votes in such ward or district at the last 10 regular election at which an officer was regularly scheduled 11 to be elected from that ward or district. 12 A "qualified primary elector" of a party may not sign 13 petitions for or be a candidate in the primary of more than 14 one party. 15 (Source: P.A. 91-57, eff. 6-30-99; 91-357, eff. 7-29-99; 16 91-358, eff. 7-29-99; revised 8-17-99.) 17 (10 ILCS 5/8-8) (from Ch. 46, par. 8-8) 18 Sec. 8-8. Form of petition for nomination. The name of 19 no candidate for nomination shall be printed upon the primary 20 ballot unless a petition for nomination shall have been filed 21 in his behalf as provided for in this Section. Each such 22 petition shall include as a part thereof the oath required by 23 Section 7-10.1 of this Act and a statement of candidacy by 24 the candidate filing or in whose behalf the petition is 25 filed. This statement shall set out the address of such 26 candidate, the office for which he is a candidate, shall 27 state that the candidate is a qualified primary voter of the 28 party to which the petition relates, is qualified for the 29 office specified and has filed a statement of economic 30 interests as required by the Illinois Governmental Ethics 31 Act, shall request that the candidate's name be placed upon 32 the official ballot and shall be subscribed and sworn by such 33 candidate before some officer authorized to take SB1109 Enrolled -11- SRS92SB0033PMcp 1 acknowledgment of deeds in this State and may be in 2 substantially the following form: 3 State of Illinois) 4 ) ss. 5 County ..........) 6 I, ...., being first duly sworn, say that I reside at 7 .... street in the city (or village of) .... in the county of 8 .... State of Illinois; that I am a qualified voter therein 9 and am a qualified primary voter of .... party; that I am a 10 candidate for nomination to the office of .... to be voted 11 upon at the primary election to be held on (insert date); 12 that I am legally qualified to hold such office and that I 13 have filed a statement of economic interests as required by 14 the Illinois Governmental Ethics Act and I hereby request 15 that my name be printed upon the official primary ballot for 16 nomination for such office. 17 Signed .................... 18 Subscribed and sworn to (or affirmed) before me by ...., 19 who is to me personally known, on (insert date). 20 Signed .... (Official Character) 21 (Seal if officer has one.) 22 All petitions for nomination for the office of State 23 Senator shall be signed by 1% or 600, whichever is greater, 24 of the qualified primary electors of the candidate's party in 25 his legislative district, except that for the first primary 26 following a redistricting of legislative districts, such 27 petitions shall be signed by at least 600 qualified primary 28 electors of the candidate's party in his legislative 29 district. 30 All petitions for nomination for the office of 31 Representative in the General Assembly shall be signed by at 32 least 1% or 300, whichever is greater, of the qualified 33 primary electors of the candidate's party in his or her 34 representative district, except that for the first primary SB1109 Enrolled -12- SRS92SB0033PMcp 1 following a redistricting of representative districts such 2 petitions shall be signed by at least 300 qualified primary 3 electors of the candidate's party in his or her 4 representative district. 5 Opposite the signature of each qualified primary elector 6 who signs a petition for nomination for the office of State 7 Representative or State Senator such elector's residence 8 address shall be written or printed. The residence address 9 required to be written or printed opposite each qualified 10 primary elector's name shall include the street address or 11 rural route number of the signer, as the case may be, as well 12 as the signer's county and city, village or town. 13 For the purposes of this Section, the number of primary 14 electors shall be determined by taking the total vote cast, 15 in the applicable district, for the candidate for such 16 political party who received the highest number of votes, 17 state-wide, at the last general election in the State at 18 which electors for President of the United States were 19 elected. 20 A "qualified primary elector" of a party may not sign 21 petitions for or be a candidate in the primary of more than 22 one party. 23 In the affidavit at the bottom of each sheet, the 24 petition circulator, who shall be a person 18 years of age or 25 older who is a citizen of the United Stateshave been a26registered voter at all times he or she circulated the27petition, shall state his or her street address or rural 28 route number, as the case may be, as well as his or her 29 county,andcity, village or town, and state; and shall 30 certify that the signatures on that sheet of the petition 31 were signed in his or her presence; and shall certify that 32 the signatures are genuine; and shall certify that to the 33 best of his or her knowledge and belief the persons so 34 signing were at the time of signing the petition qualified SB1109 Enrolled -13- SRS92SB0033PMcp 1 primary voters for which the nomination is sought. 2 In the affidavit at the bottom of each petition sheet, 3 the petition circulator shall either (1) indicate the dates 4 on which he or she circulated that sheet, or (2) indicate the 5 first and last dates on which the sheet was circulated, or 6 (3) certify that none of the signatures on the sheet were 7 signed more than 90 days preceding the last day for the 8 filing of the petition. No petition sheet shall be 9 circulated more than 90 days preceding the last day provided 10 in Section 8-9 for the filing of such petition. 11 All petition sheets which are filed with the State Board 12 of Elections shall be the original sheets which have been 13 signed by the voters and by the circulator, and not 14 photocopies or duplicates of such sheets. 15 The person circulating the petition, or the candidate on 16 whose behalf the petition is circulated, may strike any 17 signature from the petition, provided that: 18 (1) the person striking the signature shall initial 19 the petition at the place where the signature is struck; 20 and 21 (2) the person striking the signature shall sign a 22 certification listing the page number and line number of 23 each signature struck from the petition. Form of petition for nomination. All 28 petitions for nomination under this Article 10 for candidates 29 for public office in this State, shall in addition to other 30 requirements provided by law, be as follows: Such petitions 31 shall consist of sheets of uniform size and each sheet shall 32 contain, above the space for signature, an appropriate 33 heading, giving the information as to name of candidate or SB1109 Enrolled -14- SRS92SB0033PMcp 1 candidates in whose behalf such petition is signed; the 2 office; the party; place of residence; and such other 3 information or wording as required to make same valid, and 4 the heading of each sheet shall be the same. Such petition 5 shall be signed by the qualified voters in their own proper 6 persons only, and opposite the signature of each signer his 7 residence address shall be written or printed. The residence 8 address required to be written or printed opposite each 9 qualified primary elector's name shall include the street 10 address or rural route number of the signer, as the case may 11 be, as well as the signer's county, and city, village or 12 town, and state. However, the county or city, village or 13 town, and state of residence of such electors may be printed 14 on the petition forms where all of the such electors signing 15 the petition reside in the same county or city, village or 16 town, and state. Standard abbreviations may be used in 17 writing the residence address, including street number, if 18 any. No signature shall be valid or be counted in 19 considering the validity or sufficiency of such petition 20 unless the requirements of this Section are complied with. At 21 the bottom of each sheet of such petition shall be added a 22 circulator's statement, signed by a person 18 years of age or 23 older who is a citizen of the United Statesregistered voter24of the political division, who has been a registered voter at25all times he or she circulated the petition, for which the26candidate or candidates shall be nominated; stating the 27 street address or rural route numberof the voter, as the 28 case may be, as well as thevoter'scounty,andcity, village 29 or town, and state; certifying that the signatures on that 30 sheet of the petition were signed in his or her presence; 31 certifying that the signatures are genuine; and either (1) 32 indicating the dates on which that sheet was circulated, or 33 (2) indicating the first and last dates on which the sheet 34 was circulated, or (3) certifying that none of the signatures SB1109 Enrolled -15- SRS92SB0033PMcp 1 on the sheet were signed more than 90 days preceding the last 2 day for the filing of the petition, or more than 45 days3preceding the last day for filing of the petition in the case4of political party and independent candidates for single or5multi-county regional superintendents of schools in the 19946general primary election; and certifying that to the best of 7 his knowledge and belief the persons so signing were at the 8 time of signing the petition duly registered voters under 9 Articles 4, 5 or 6 of the Code of the political subdivision 10 or district for which the candidate or candidates shall be 11 nominated, and certifying that their respective residences 12 are correctly stated therein. Such statement shall be sworn 13 to before some officer authorized to administer oaths in this 14 State. No petition sheet shall be circulated more than 90 15 days preceding the last day provided in Section 10-6 for the 16 filing of such petition, or more than 45 days preceding the17last day for filing of the petition in the case of political18party and independent candidates for single or multi-county19regional superintendents of schools in the 1994 general20primary election. Such sheets, before being presented to the 21 electoral board or filed with the proper officer of the 22 electoral district or division of the state or municipality, 23 as the case may be, shall be neatly fastened together in book 24 form, by placing the sheets in a pile and fastening them 25 together at one edge in a secure and suitable manner, and the 26 sheets shall then be numbered consecutively. The sheets 27 shall not be fastened by pasting them together end to end, so 28 as to form a continuous strip or roll. All petition sheets 29 which are filed with the proper local election officials, 30 election authorities or the State Board of Elections shall be 31 the original sheets which have been signed by the voters and 32 by the circulator, and not photocopies or duplicates of such 33 sheets. A petition, when presented or filed, shall not be 34 withdrawn, altered, or added to, and no signature shall be SB1109 Enrolled -16- SRS92SB0033PMcp 1 revoked except by revocation in writing presented or filed 2 with the officers or officer with whom the petition is 3 required to be presented or filed, and before the presentment 4 or filing of such petition. Whoever forges any name of a 5 signer upon any petition shall be deemed guilty of a forgery, 6 and on conviction thereof, shall be punished accordingly. 7 The word "petition" or "petition for nomination", as used 8 herein, shall mean what is sometimes known as nomination 9 papers, in distinction to what is known as a certificate of 10 nomination. The words "political division for which the 11 candidate is nominated", or its equivalent, shall mean the 12 largest political division in which all qualified voters may 13 vote upon such candidate or candidates, as the state in the 14 case of state officers; the township in the case of township 15 officers et cetera. Provided, further, that no person shall 16 circulate or certify petitions for candidates of more than 17 one political party, or for an independent candidate or 18 candidates in addition to one political party, to be voted 19 upon at the next primary or general election, or for such 20 candidates and parties with respect to the same political 21 subdivision at the next consolidated election. 22 (Source: P.A. 91-57, eff. 6-30-99.) 23 (10 ILCS 5/28-3) (from Ch. 46, par. 28-3) 24 Sec. 28-3. Form of petition for public question. 25 Petitions for the submission of public questions shall 26 consist of sheets of uniform size and each sheet shall 27 contain, above the space for signature, an appropriate 28 heading, giving the information as to the question of public 29 policy to be submitted, and specifying the state at large or 30 the political subdivision or district or precinct or 31 combination of precincts or other territory in which it is to 32 be submitted and, where by law the public question must be 33 submitted at a particular election, the election at which it SB1109 Enrolled -17- SRS92SB0033PMcp 1 is to be submitted. In the case of a petition for the 2 submission of a public question described in subsection (b) 3 of Section 28-6, the heading shall also specify the regular 4 election at which the question is to be submitted and include 5 the precincts included in the territory concerning which the 6 public question is to be submitted, as well as a common 7 description of such territory in plain and nonlegal language, 8 such description to describe the territory by reference to 9 streets, natural or artificial landmarks, addresses or any 10 other method which would enable a voter signing the petition 11 to be informed of the territory concerning which the question 12 is to be submitted. The heading of each sheet shall be the 13 same. Such petition shall be signed by the registered voters 14 of the political subdivision or district or precinct or 15 combination of precincts in which the question of public 16 policy is to be submitted in their own proper persons only, 17 and opposite the signature of each signer his residence 18 address shall be written or printed, which residence address 19 shall include the street address or rural route number of the 20 signer, as the case may be, as well as the signer's county, 21 and city, village or town, and state; provided that the 22 county or city, village or town, and state of residence of 23 such electors may be printed on the petition forms where all 24 of the such electors signing the petition reside in the same 25 county or city, village or town, and state. Standard 26 abbreviations may be used in writing the residence address, 27 including street number, if any. No signature shall be valid 28 or be counted in considering the validity or sufficiency of 29 such petition unless the requirements of this Section are 30 complied with. 31 At the bottom of each sheet of such petition shall be 32 added a circulator's statement, signed by a person 18 years 33 of age or older who is a citizen of the United States 34registered voter, who has been a registered voter at allSB1109 Enrolled -18- SRS92SB0033PMcp 1times he or she circulated the petition, of the political2subdivision or district or precinct or combination of3precincts in which the question of public policy is to be4submitted, stating the street address or rural route number 5of the voter, as the case may be, as well as thevoter's6 county,andcity, village or town, and state; certifying that 7 the signatures on that sheet of the petition were signed in 8 his or her presence and are genuine, and that to the best of 9 his or her knowledge and belief the persons so signing were 10 at the time of signing the petition registered voters of the 11 political subdivision or district or precinct or combination 12 of precincts in which the question of public policy is to be 13 submitted and that their respective residences are correctly 14 stated therein. Such statement shall be sworn to before some 15 officer authorized to administer oaths in this State. 16 Such sheets, before being filed with the proper officer 17 or board shall be bound securely and numbered consecutively. 18 The sheets shall not be fastened by pasting them together end 19 to end, so as to form a continuous strip or roll. All 20 petition sheets which are filed with the proper local 21 election officials, election authorities or the State Board 22 of Elections shall be the original sheets which have been 23 signed by the voters and by the circulator, and not 24 photocopies or duplicates of such sheets. A petition, when 25 presented or filed, shall not be withdrawn, altered, or added 26 to, and no signature shall be revoked except by revocation in 27 writing presented or filed with the board or officer with 28 whom the petition is required to be presented or filed, and 29 before the presentment or filing of such petition, except as 30 may otherwise be provided in another statute which authorize 31 the public question. Whoever forges any name of a signer upon 32 any petition shall be deemed guilty of a forgery, and on 33 conviction thereof, shall be punished accordingly. 34 In addition to the foregoing requirements, a petition SB1109 Enrolled -19- SRS92SB0033PMcp 1 proposing an amendment to Article IV of the Constitution 2 pursuant to Section 3 of Article XIV of the Constitution or a 3 petition proposing a question of public policy to be 4 submitted to the voters of the entire State shall be in 5 conformity with the requirements of Section 28-9 of this 6 Article. 7 If multiple sets of petitions for submission of the same 8 public questions are filed, the State Board of Elections, 9 appropriate election authority or local election official 10 where the petitions are filed shall within 2 business days 11 notify the proponent of his or her multiple petition filings 12 and that proponent has 3 business days after receipt of the 13 notice to notify the State Board of Elections, appropriate 14 election authority or local election official that he or she 15 may cancel prior sets of petitions. If the proponent 16 notifies the State Board of Elections, appropriate election 17 authority or local election official, the last set of 18 petitions filed shall be the only petitions to be considered 19 valid by the State Board of Elections, appropriate election 20 authority or local election official. If the proponent fails 21 to notify the State Board of Elections, appropriate election 22 authority or local election official then only the first set 23 of petitions filed shall be valid and all subsequent 24 petitions shall be void. 25 (Source: P.A. 91-57, eff. 6-30-99.) 26 Section 99.
