1 AN ACT in relation to public health.
2 Be it enacted by the People of the State of Illinois,
3 represented in the General Assembly:
4 Section 5. The Department of Public Health Act is
5 amended by changing Section 8.1 as follows:
6 (20 ILCS 2305/8.1) (from Ch. 111 1/2, par. 24)
7 Sec. 8.1. Whoever violates or refuses to obey any rule
8 or regulation of the Department of Public Health is shall be
9 deemed guilty of a Class A misdemeanor. The Director of
10 Public Health shall institute prosecutions and proceedings
11 for violation of the rules and regulations adopted by the
12 Department of Public Health, provided that he may designate a
13 local board of health or local health officer to institute
14 prosecutions or proceedings for violation of those rules and
15 regulations adopted by the Department. Each State's Attorney
16 shall prosecute all persons in his county violating or
17 refusing to obey the rules and regulations of the Department
18 of Public Health. All fines or judgments collected or
19 received shall be paid to the County Treasurer of the county
20 in which prosecution is conducted.
